      After careful review of your application, military records and all
other available evidence, the Army Discharge Review Board determined that
you were properly and equitably discharged.  Accordingly, your request for
a change in the character and/or reason of your discharge is denied.

      You may reapply to the Army Discharge Review Board for a personal
appearance hearing and/or you may apply to the Army Board for Correction of
Military Records.  Enclosed are the necessary applications for requesting a
review from both boards.  If you choose to apply to the Army Board for
Correction of Military Records you must do so within three years from the
date of this letter.

      Be advised that the Army Discharge Review Board operates on a 15-year
statute of limitations from the date of discharge; therefore, you must
reapply within this time frame for a hearing.

      If you believe that the decision in your case is unclear, not
responsive to the issues raised, or does not otherwise agree with the
decisional document requirements of DoD Directive 1332.28, you may submit a
complaint in accordance with Enclosure 5 of that Directive.  The complaint
procedure does not permit you to challenge the merits of the decision, but
is designed solely to ensure that the decisional document meets applicable
requirements for clarity and responsiveness.  You may obtain a copy of DoD

                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The specific facts and circumstances pertaining to the
applicant’s release from active duty are not contained in the available
records.  Evidence of record shows that on 16 August 1994, State of
Michigan, Department of Military Affairs, Lansing, Michigan, Orders 158-
088, released the applicant from active duty and assigned him to the 1171
QM Co, Detroit, Michigan effective 17 August 1994.  The record contains a
properly constituted DD Form 214 (Certificate of Release or Discharge from
Active Duty).  His DD Form 214 indicates that he was released from active
duty by order of the Michigan Department of Military Affairs by reason of
substandard duty performance-inappropriate professional and personal
conduct, with an honorable discharge.

      b.  On 17 August 1994, the applicant was released from active duty
and returned to his unit in the Michigan Army National Guard.  At the time
of release, the applicant had completed 8 years, 5 months, and 24 days of
active military service and accrued 1 day of lost time due to AWOL in the
period under review and had a total of 10 years, 10 months and 14 days of
military service.

      c.  On 14 November 1995, the applicant was discharged from the
Michigan Army National Guard and as a Reserve of the Army under the
provisions of NGR 600-200, Chapter 8-26q, by reason of acts or patterns of
misconduct with an under other than honorable conditions discharge.  He was
reduced to the lowest enlisted grade.

        (1)  The issue is rejected.  The applicant’s record is void of
facts and circumstances concerning events that led to his release from
active duty.  The Board noted that the applicant’s record contains a
properly constituted DD Form 214 (Certificate of Release or Discharge from
Active Duty.)  This document identifies the reason and characterization of
applicant’s release from active duty and the Board presumed government
regularity in the administrative process.  The applicant provided no
independent corroborating evidence demonstrating that the command’s action
was erroneous.  The Board, being convinced that the reason for release from
active duty and the characterization of service were both proper and
equitable, voted to deny relief.

      b.  Equity:      The applicant has not submitted an issue of equity
                   and the ADRB has not otherwise relied upon an issue of
