      After careful review of your application, military records and all

a change in the character and/or reason of your discharge is denied.

      You may reapply to the Army Discharge Review Board for a personal
appearance hearing and/or you may apply to the Army Board for Correction of
Military Records.  Enclosed are the necessary applications for requesting a
review from both boards.  If you choose to apply to the Army Board for
Correction of Military Records you must do so within three years from the
date of this letter.

      Be advised that the Army Discharge Review Board operates on a 15-year
statute of limitations from the date of discharge; therefore, you must
reapply within this time frame for a hearing.

      If you believe that the decision in your case is unclear, not
responsive to the issues raised, or does not otherwise agree with the
decisional document requirements of DoD Directive 1332.28, you may submit a
complaint in accordance with Enclosure 5 of that Directive.  The complaint
procedure does not permit you to challenge the merits of the decision, but

                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  All the specific facts and circumstances pertaining to the
applicant’s discharge are not contained in the available records.  The
available evidence of record shows that the applicant was charged with
failing to go to his appointed place of duty (010321); disobeying a lawful
command from LTC by breaking restriction (010204); disobeying a lawful
order from 1SG (010221); disobeying lawful order from SSG, two
specifications on (010312); and wrongfully using marijuana, two
specifications (001007-001107; 000104-000204).  (Note:  Page 1 of DD Form
458-Charge Sheet, which contained four specifications, is not in file.) The
applicant’s voluntary request for discharge in lieu of trial by court-
martial under the provisions of Chapter 10, AR 635-200, is not in the
official record.  However, the separation authority’s approval of the
applicant’s voluntary request is available in the record.  This shows that
separation authority approved the applicant’s voluntary request for
separation with an under other than honorable conditions discharge.  The
record also contains a properly constituted DD Form 214 (Certificate of
Release or Discharge from Active Duty) which was authenticated by the
applicant.  His DD Form 214 indicates that he was discharged under the
provisions of Chapter 10, AR 635-200 by reason of for the good of the
service-in lieu of trial by court-martial, with a characterization of
service of under other than honorable conditions.  The applicant was
reduced to the lowest enlisted grade.

      b.  On 4 May 2001, the applicant was discharged.  At the time of
discharge, the applicant had completed 2 years, 6 months, and 18 days of
active military service in the period under review and had a total of 5
years, 6 months
and 24 days of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt.  Army policy states
that although an honorable or general discharge is authorized, a discharge
UOHC is normally considered appropriate.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

                   Paragraph 1, above.

        (1)  The issue is rejected.  The Board carefully examined the
available record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  The Board noted that the applicant’s record
contains a properly constituted DD Form 214 (Certificate of Release or
Discharge from Active Duty) which was authenticated by the applicant.  This
document identifies the reason and characterization of the discharge and
the Board presumed Government regularity in the discharge process.  The
evidence of record shows the applicant was discharged under the provisions
of Chapter 10, AR 635-200, for the good of the service in lieu of trial by
court-martial.  In connection with such a discharge, the applicant was
charged with the commission of an offense punishable under the Uniform Code
of Military Justice (UCMJ) with a punitive discharge.  Procedurally, the
applicant was required to consult with defense counsel and to voluntarily,
and in writing, request separation from the Army in lieu of trial by court-
martial.  In doing so, the applicant admitted guilt to the stipulated or
lesser-included offenses under the UCMJ.  In the absence of information to
the contrary, the Board was satisfied that all requirements of law and
regulation were met and the rights of the applicant were fully protected
throughout the separation process.  It also noted that the characterization
of service for this type of discharge is normally under other than
honorable conditions and that the applicant would have been aware of that
prior to requesting discharge.  An individual may be processed through the
physical disability system upon the direction of the general court-martial
convening authority (GCMCA) when it is determined that the individual’s
medical condition is the direct or substantial contributing cause of the
conduct that led to the recommendation for administration elimination.  It
appears that the GCMCA determined that the applicant’s medical condition
was not the direct or substantial contributing cause of his misconduct.
The Board, being convinced that the reason for discharge and the
characterization of service were both proper and equitable, voted to deny
relief.
