                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  On 23 May 2002, the applicant reenlisted in the Army Reserve for
a period of one year (extension of one year on 021019).  On 6 December
2002, the applicant was mobilized in support of Operation Enduring Freedom
for a period of one (1) year and ordered to report to Fort Bliss, Texas.
All the specific facts and circumstances pertaining to the applicant’s
discharge are not contained in the available records.  However, the
applicant submitted evidence showing that while at Fort Bliss, Texas, he
was diagnosed with diabetes and recommended for a medical evaluation board.
 While awaiting his medical board, the applicant reported that he used
illegal drugs and was recommended for discharge under the provisions of
Chapter 14, AR 635-200, by reason of misconduct.  The record contains a
properly constituted DD Form 214 (Certificate of Release or Discharge from
Active Duty) which was authenticated by the applicant.  His DD Form 214
indicates that he was discharged under the provisions of Chapter 14, AR 635-
200 by reason of misconduct – use of illegal drugs, with a characterization
of service of general, under honorable conditions.

      b.  On 13 November 2003, the applicant was discharged.  At the time
of discharge, the applicant had completed 11 months and 9 days of active
military service in the period under review and had a total of 14 years, 8
months and
13 days of military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct.  Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave.  Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed.  Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

                   Paragraph 1, above.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infraction of discipline, the extent thereof, and the
seriousness of the offense.  Although the Board does not condone the
applicant’s misconduct, the Board determined that the applicant’s ability
to serve was impaired by his medical and mental conditions, as well as
occupational and relationship problems as verified by competent medical
authorities.  Given the foregoing, and the Board found that the
characterization of service granted is now inequitable.  Accordingly, the
Board voted to grant relief in the form of an upgrade of characterization
of service to fully honorable.  The Board determined that the reason for
discharge was both proper and equitable and voted not to change it.
