                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The evidence of record shows that on 30 November 1999, the
applicant was charged with AWOL from (991013-991122).  On 30 November 1999,
the applicant consulted with legal counsel and voluntarily requested, in
writing, discharge under the provisions of Chapter l0, AR 635-200 in lieu
of trial by court-martial.  In this request, the applicant admitted guilt
to the offense, or a lesser included offense.  Further, the applicant
indicated that he understood that he could receive an under other than
honorable conditions discharge and that the discharge would have a
significant effect on eligibility for veteran’s benefits.  The applicant
did not submit a statement in his own behalf.  The unit commander
recommended approval of an under other than honorable conditions discharge.
 On 21 December 2000, the separation authority approved the discharge with
an under other than honorable conditions discharge.  The applicant was to
be reduced to the lowest enlisted rank.

      b.  On 28 February 2001, the applicant was discharged.  At the time
of discharge, the applicant had completed 3 years, 4 months, and 17 days of
active military service and accrued 40 days of lost time in the period
under review and had a total of 10 years, 1 months and 23 days of active
military service.

      c.  The applicant was placed on excess leave for a total of 456 days
(991201-010228).

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt.  Army policy states
that although an honorable or general discharge is authorized, a discharge
under other than honorable conditions is normally considered appropriate.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

      b.  Equity:      The parenthetical number(s) below correspond(s) to
                   the issue number(s) on the DD Form 293, or in Part VI,
                   Paragraph 1, above.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infraction of discipline, the extent thereof, and the
seriousness of the offense.  While the Board does not condone the
applicant’s misconduct, it determined that the characterization of service
is inequitable.  The Board found that the overall length and quality of the
applicant’s service to include his awards and decorations mitigated the
misconduct in the service record.  Accordingly, the Board voted to grant
relief in the form of an upgrade of characterization of service to general,
under honorable conditions.  The Board determined that the reason for
discharge was both proper and equitable and voted not to change it.
