                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 12 January 2001, the unit
commander in consultation with the Chief, Alcohol/Drug Abuse Prevention and
Control Office declared the applicant a rehabilitation failure.  On 18
January 2001, the unit commander notified the applicant of initiation of
separation action under the provisions of Chapter 9, AR 635-200, by reason
of alcohol rehabilitation failure, with a general, under honorable
conditions discharge.  He was advised of his rights.  The applicant
consulted with legal counsel, was advised of the impact of the discharge
action, and did not submit a statement in his own behalf.  The unit
commander subsequently recommended separation from the service.  On 19
January 2001, the intermediate commander recommended approval with a
general discharge.  On 29 January 2001, the separation authority directed
that the applicant be discharged with a characterization of service of
general, under honorable conditions.

      b.  On 2 February 2001, the applicant was discharged.  At the time of
discharge, the applicant had completed 1 year, 6 months, and 27 days of
active military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 9 contains the authority and outlines the procedures for
discharging individuals because of alcohol or other drug abuse.  A member
who has been referred to the Alcohol and Drug Abuse Prevention and Control
Program (ADAPCP) for alcohol/drug abuse may be separated because of
inability or refusal to participate in, cooperate in, or successfully
complete such a program if there is a lack of potential for continued Army
service and rehabilitation efforts are no longer practical.  Army policy
states that an honorable or general discharge is authorized depending on
the applicant’s overall record of service.  (However, an honorable
discharge is required if restricted use information is used in the
discharge process).

                   issue of propriety to change the discharge.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as his abuse of drugs and alcohol.  Notwithstanding the propriety of
the discharge process, the Board determined that the characterization of
service is inequitable.  The Board noted that except for his substance
abuse problem the applicant received no nonjudicial punishment under the
provisions of Article 15, UCMJ, and his service was otherwise honorable.
Accordingly, the Board voted to grant partial relief in the form of an
upgrade of characterization of service to fully honorable.

        (1)  The issue is rejected.  The Board determined that the reason
for discharge was both proper and equitable and voted not to change it.
Further, based on the applicant’s narrative reason for separation, he was
appropriately assigned a reentry eligibility (RE) code of “4.”  See issue
(2) above.
