PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 20 May 2002, the applicant
enlisted in the Army Reserve for a period of 8 years. On 31 July 2002, he
was ordered to initial active duty for training (IADT) for a period of 30
weeks. On 30 April 2003, while at IADT, the unit commander notified the
applicant of initiation of separation action under the provisions of
Chapter l3, AR 635-200, by reason of unsatisfactory performance, with a
general, under honorable conditions discharge. The reason for the proposed
action was his conviction at Summary Court-Martial for violating the
written alcohol policy, committing sodomy, and providing alcohol to minors.
He was advised of his rights. On 3 May 2003, the applicant consulted with
legal counsel, was advised of the impact of the discharge action, and
submitted statements in his own behalf. The unit commander recommended
separation from the service and waiver of further rehabilitative efforts.
On 6 May 2003, the separation authority waived further rehabilitative
efforts and directed that the applicant be discharged with a
characterization of service of general, under honorable conditions.
b. On 8 May 2003, the applicant was discharged. At the time of
discharge, the applicant had completed 9 months and 8 days of active
military service in the period under review and had a total of 11 months
and 19 days of total military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 13 contains the policy and outlines the procedures for separating
individuals for unsatisfactory performance, and provides, in pertinent
part, that commanders will separate a member under this chapter when, in
the commander's judgment, the member will not develop sufficiently to
participate satisfactorily in further training and/or become a satisfactory
soldier. Army policy states that a general discharge, under honorable
conditions is normally considered appropriate, but an honorable discharge
may be granted in meritorious cases.

(1) The issue is rejected. The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as the incidents of unsatisfactory performance. The Board noted the
applicant’s contentions, however, the Board found a sufficient pattern of
unsatisfactory performance in his official record to warrant the separation
action under review. The applicant's discharge was appropriate because the
quality of his service was not consistent with the Army's standards for
acceptable personal conduct and performance of duty by military personnel.
The Board found no evidence of arbitrary or capricious actions by the
command. The Board was satisfied that all requirements of law and
regulation were met and the rights of the applicant were fully protected
throughout the separation process. Before initiating action to separate
the applicant, the command ensured the applicant was appropriately
counseled about the deficiencies that could lead to separation. The Board
noted that the command made an assessment thereafter of the applicant's
potential for becoming a fully satisfactory soldier, and the command
appropriately determined the applicant did not demonstrate the potential
for further military service. The Board, being convinced that the reason
for discharge and the characterization of service were both proper and
equitable, voted to deny relief.
