                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  All the specific facts and circumstances pertaining to the
applicant’s discharge are not contained in the available records.  Evidence
of record shows that on 24 April 2003, DA, HQ, 10th Mountain Division
(Light Infantry) and Fort Drum, Fort Drum, NY, Orders 114-1014 discharged
the applicant from the Regular Army, effective 6 May 2003.  The record also
contains a properly constituted DD Form 214 (Certificate of Release or
Discharge from Active Duty) which was authenticated by the applicant.  His
DD Form 214 indicates that he was discharged under the provisions of
Chapter 14, AR 635-200 by reason of misconduct, with a characterization of
service of general, under honorable conditions.  In addition, the applicant
has submitted a copy of the unit commander’s memorandum initiating
administrative separation procedures dated 5 March 2003.  In this
memorandum, the unit commander indicates that he was initiating separation
action because the applicant drove while intoxicated which caused him to be
denied a security clearance; he was found drunk on duty; and he disobeyed
an order to not consumer alcoholic beverages while at a field exercise.

      b.  On 6 May 2003, the applicant was discharged.  At the time of
discharge, the applicant had completed 3 years, 2 months, and 18 days of
active military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct.  Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave.  Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed.  Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  Although the Board does not condone the
applicant’s misconduct, the Board determined that the applicant had service
of sufficient merit to overcome the discrediting entries in his service
record.  In addition, the applicant has provided evidence of favorable post-
service conduct and the Board found that the characterization of service
granted is now inequitable.  Accordingly, the Board voted to grant relief
in the form of an upgrade of characterization of service to fully
honorable.  The Board determined that the reason for discharge was both
proper and equitable and voted not to change it.
