                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 9 March 2000, DA, HQ, U.S. Army
Transportation Center, Fort Eustis, Virginia, Orders 069-0009 discharged
the applicant from the Regular Army, effective 14 March 2000.  The record
contains a properly constituted DD Form 214 (Certificate of Release or
Discharge from Active Duty), which was authenticated by the applicant.  His
DD Form 214 indicates that he was discharged under the provisions of
Chapter 10, AR 635-200 by reason of for the good of the service-in lieu of
trial by court-martial, with a characterization of service of under other
than honorable conditions.  On 8 March 2000, the separation authority
waived further rehabilitative efforts and directed that the applicant be
discharged with a characterization of service of general, under honorable
conditions.  The specific facts and circumstances pertaining to the
applicant’s discharge are not contained in the available records.

      b.  On 14 March 2000, the applicant was discharged.  At the time of
discharge, the applicant had completed 6 months and 15 days of active
military service and accrued 11 days of lost time in the period under
review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt.  Army policy states
that although an honorable or general discharge is authorized, a discharge
UOHC is normally considered appropriate.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

                   Paragraph 1, above.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infraction of discipline, the extent thereof, and the
seriousness of the offense.  The Board does not condone the applicant’s
misconduct; however, the Board found that the characterization of service
was inequitable.  The Board found sufficient mitigating circumstances
surrounding the nature of the applicant’s discharge to partially overcome
the characterization of service granted.  Accordingly, the Board voted to
grant partial relief in the form of an upgrade of characterization of
service to general, under honorable conditions.  The Board determined that
the reason for discharge was both proper and equitable and voted not to
change it.

        (1)  The issue is rejected.  The Board determined that the
applicant’s misconduct diminished the quality of his service below that
meriting a fully honorable discharge.  Individuals are assigned RE codes
based on their service records or the reason for discharge.  The applicant
was appropriately assigned an RE code of 3.  This Board found no bases upon
which to change the applicant’s reason for discharge.  An RE Code of 3
indicates that the applicant requires a waiver prior to being allowed to
reenlist.  If the applicant desires to reenlist, he should contact the
local recruiter to determine his eligibility to reenlist.  Those
individuals can best advise a former service member as to the needs of the
Army at the time, and are required to process waivers of RE codes.
