                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The evidence of record shows that on 13 August 2002, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory
performance, with a general, under honorable conditions discharge.  She was
advised of her rights.  The applicant consulted with legal counsel, was
advised of the impact of the discharge action, and did not submit a
statement in her own behalf.  The unit commander subsequently recommended
separation from the service and waiver of further rehabilitative efforts.
The separation authority waived further rehabilitative efforts and directed
that the applicant be discharged with a characterization of service of
general, under honorable conditions.

      b.  On 20 August 2002, the applicant was discharged.  At the time of
discharge, the applicant had completed 7 months, and 14 days of active
military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 13 contains the policy and outlines the procedures for separating
individuals for unsatisfactory performance, and provides, in pertinent
part, that commanders will separate a member under this chapter when, in
the commander's judgment, the member will not develop sufficiently to
participate satisfactorily in further training and/or become a satisfactory
soldier.  Army policy states that a general discharge, under honorable
conditions is normally considered appropriate, but an honorable discharge
may be granted in meritorious cases.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 The evidence of record shows that the applicant’s separation was initiated
while the applicant was in an entry-level status (i.e., had less than 180
days of continuous active duty service and had not been awarded a military
occupational specialty (MOS)).  Chapter 13, Paragraph 13-1, AR 635-200,
provides that soldiers in entry-level status are not to be processed for
separation under the provisions of Chapter 13.  In view of the foregoing,
the Board determined that the discharge was and is improper.  Accordingly,
the Board voted to grant full relief in the form of an upgrade of
characterization of service to fully honorable and a change to the
narrative reason for separation to Secretarial Authority.
