SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The evidence of record shows that on 15 July 2002, the applicant
was charged with conspiracy to wrongfully and falsely make military
identification cards; wrongfully and falsely make military ID cards in the
names of 2 PVTs with photographs of other individuals (001101-010804);
wrongfully give to individuals military ID cards; wrongfully and falsely
make a DA Form 31, in words and figures in the name of PFC (010501-010804);
and, wrongfully and falsely make a DA Form 31 in the name of PFC (010501-
010804). On 4 October 2002, the applicant consulted with legal counsel and
voluntarily requested, in writing, discharge under the provisions of
Chapter l0, AR 635-200 in lieu of trial by court-martial. In this request,
the applicant admitted guilt to the offenses, or lesser-included offenses.
Further, the applicant indicated that he understood that he could receive
an under other than honorable conditions discharge and that the discharge
would have a significant effect on eligibility for veteran’s benefits. The
applicant did not submit a statement in his own behalf. On 3 May 2002, the
unit commander and intermediate commander recommended disapproval of the
Chapter 10 request and trial by general court-martial On 13 May 2002, the
separation authority disapproved the applicant’s discharge in lieu of trial
by court-martial. On 25 October 2002, the applicant was arraigned by
general court-martial; however, his request for discharge pursuant to the
provisions of Chapter 10, AR 635-200, was approved and all charges and
specifications were dismissed. On 25 October 2002, the separation
authority approved the discharge with an under other than honorable
conditions discharge. The separation authority directed that the discharge
be executed only after disposition of any charges against the co-
conspirator(s), but in no event delayed longer than 120 days unless
approved by the separation authority. The applicant was to be reduced to
the lowest enlisted rank.
b. On 21 February 2003, the applicant was discharged. At the time
of discharge, the applicant had completed 2 years, 5 months, and 21 days of
active military service in the period under review and had a total of 5
years, 9 months and 15 days of active military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt. Army policy states
that although an honorable or general discharge is authorized, a discharge
UOHC is normally considered appropriate.

(1-4) The issues are rejected. The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as infraction of discipline, the extent thereof, and the seriousness
of the offense.
The Board noted the applicant’s contentions; however, the official record
does not support the applicant’s contentions and the Board determined that
his contentions were not sufficiently mitigating to warrant an upgrade of
the discharge under review. The evidence of record shows the applicant was
charged with the commission of an offense punishable under the Uniform Code
of Military Justice (UCMJ) with a punitive discharge. The Board noted
that, after consulting with defense counsel, the applicant voluntarily, and
in writing, requested separation from the Army in lieu of trial by court-
martial. In doing so, the applicant admitted guilt to the stipulated or
lesser-included offenses under the UCMJ. The Board was satisfied that all
requirements of law and regulation were met and the rights of the applicant
were fully protected throughout the separation process. It also noted that
the characterization of service for this type of discharge is normally
under other than honorable conditions and that the applicant was aware of
that prior to requesting discharge. The Board, being convinced that the
reason for discharge and the characterization of service were both proper
and equitable, voted to deny relief.
