PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The evidence of record shows that on 9 May 1995, the applicant
was charged with AWOL from (941129-950508). On 9 May 1995, the applicant
consulted with legal counsel and voluntarily requested, in writing,
discharge under the provisions of Chapter l0, AR 635-200 in lieu of trial
by court-martial. In this request, the applicant admitted guilt to the
offense, or a lesser included offense. Further, the applicant indicated
that she understood that she could receive an under other than honorable
conditions discharge and that the discharge would have a significant effect
on eligibility for veteran’s benefits. The applicant did not submit a
statement in her own behalf. The unit commander recommended approval of an
under other than honorable conditions discharge. On 2 June 1995, the
separation authority approved the discharge with an under other than
honorable conditions discharge. The applicant was to be reduced to the
lowest enlisted rank.
b. On 20 July 1995, the applicant was discharged. At the time of
discharge, the applicant had completed 9 months, and 6 days of active
military service and accrued 160 days of lost time in the period under
review.
c. The applicant requested to be put on excess leave pending
finalization of his chapter 10, discharge proceedings, effective date:
(950510-950720) totaling 72 days.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt. Army policy states
that although an honorable or general discharge is authorized, a discharge
under other than honorable conditions is normally considered appropriate.

a. Propriety: The applicant has not submitted an issue of
propriety and the ADRB has not otherwise relied upon an
issue of propriety to change the discharge.

(1) The issue is rejected. The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as the infraction of discipline, the extent thereof, and the
seriousness of the offense. The Board noted the applicant’s contentions,
however; did not find said contentions sufficiently mitigating to warrant
an upgrade of the discharge under review. The evidence of record shows the
applicant was charged with the commission of an offense punishable under
the Uniform Code of Military Justice (UCMJ) with a punitive discharge. The
Board noted, after consulting with defense counsel, the applicant
voluntarily, and in writing, requested separation from the Army in lieu of
trial by court-martial. In doing so, the applicant admitted guilt to the
stipulated or lesser-included offenses under the UCMJ. The Board was
satisfied that all requirements of law and regulation were met and the
rights of the applicant were fully protected throughout the separation
process. It also noted that the characterization of service for this type
of discharge is normally under other than honorable conditions and that the
applicant was aware of that prior to requesting discharge. Further, the
Board does not grant relief solely for the purpose of gaining employment or
enhancing employment opportunities. Eligibility for veteran's benefits to
include educational benefits under the Montgomery GI Bill does not fall
within the purview of this Board. Accordingly, the applicant should
contact a local office of the Department of Veterans Affairs for further
assistance. The Board, being convinced that the reason for discharge and
the characterization of service were both proper and equitable, voted to
deny relief.
