                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  All the facts and circumstances pertaining to the applicant’s
discharge are not contained in the available records.  Evidence of record
shows that the unit commander notified the applicant of initiation of
separation action under the provisions of Chapter l4, AR 635-200, by reason
of misconduct—commission of a serious offense, with a general, under
honorable conditions discharge.  He was advised of his rights.  The
specific reason for the action was the loss of his security clearance
because of a positive urinalysis for marijuana.  On 6 February 2003, the
applicant consulted with legal counsel, was advised of the impact of the
discharge action, and submitted a statement in his own behalf.  The unit
commander subsequently recommended separation from the service and waiver
of further rehabilitative efforts.  The separation authority’s final
decision is not contained in the available records.  However, the record
contains a properly constituted DD Form 214 (Certificate of Release or
Discharge from Active Duty), which was authenticated by the applicant’s
signature.  His DD Form 214 indicates that he was discharged under the
provisions of Chapter 14, paragraph 14-12c(2), AR 635-200 by reason of
misconduct, with a characterization of service of general, under honorable
conditions, a separation code of JKK (i.e. misconduct-commission of a
serious offense-abuse of illegal drugs), and an RE Code of 3.

      b.  On 26 February 2003, the applicant was discharged.  At the time
of discharge, the applicant had completed 2 years, 7 months, and 20 days of
active military service in the period.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct.  Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave.  Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed.  Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

        (1)  The issue is rejected.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infraction of discipline, the extent thereof, and the
seriousness of the offenses.  The applicant, by violating the Army's policy
not to possess or use illegal drugs, compromised the trust and confidence
placed in a soldier.  The applicant, as a soldier, had the duty to support
and abide by the Army's drug policies.  By abusing illegal drugs, the
applicant knowingly risked a military career and diminished the quality of
service below that meriting a fully honorable discharge.  The Board, being
convinced that the reason for discharge and the characterization of service
were both proper and equitable, voted to deny relief.
