                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 3 September 1996, the applicant
was enrolled into the ADAPCP outpatient services.  On 11 February 1997, he
was involved in a second alcohol related incident.  On 27 February 1997,
the unit commander in consultation with the Clinical Director, Community
Counseling Center declared the applicant a rehabilitation failure.  On 3
July 1997, the unit commander notified the applicant of initiation of
separation action under the provisions of Chapter 9, AR 635-200, by reason
of alcohol abuse rehabilitation failure, with a general, under honorable
conditions discharge.  He was advised of his rights.  On 11 July 1997, the
applicant consulted with legal counsel and was advised of the impact of the
discharge action.  His rights election statement indicates he submitted a
statement in his own behalf; however, his statement is not contained in the
available records.  The unit commander subsequently recommended separation
from the service.  On 14 July 1997, the separation authority directed that
the applicant be discharged with a characterization of service of general,
under honorable conditions.

      b.  On 8 August 1997, the applicant was discharged.  At the time of
discharge, the applicant had completed 3 years, 8 months, and 16 days of
active military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 9 contains the authority and outlines the procedures for
discharging individuals because of alcohol or other drug abuse.  A member
who has been referred to the Alcohol and Drug Abuse Prevention and Control
Program (ADAPCP) for alcohol/drug abuse may be separated because of
inability or refusal to participate in, cooperate in, or successfully
complete such a program if there is a lack of potential for continued Army
service and rehabilitation efforts are no longer practical.  Army policy
states that an honorable or general discharge is authorized depending on
the applicant’s overall record of service.  (However, an honorable
discharge is required if restricted use information is used in the
discharge process).

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

                   Paragraph 1, above.

        (3)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  The Board does not condone the applicant’s
misconduct; however, determined that the characterization of service is
inequitable.  The Board found that the applicant’s misconduct was partially
mitigated by his dependency on alcohol and the overall length and quality
of his service.  Accordingly, the Board voted to grant partial relief in
the form of an upgrade of characterization of service to fully honorable.
The Board determined that the reason for discharge was proper and equitable
and voted not to change it.

        (1)  The issue is rejected.  The Board noted that the applicant was
properly assigned a reentry eligibility (RE) code of “4” at the time of
discharge.  An RE-4 simply means that the applicant is no longer eligible
for reenlistment.  This Board cannot change the applicant’s RE code.  To
obtain a change in an RE code, the applicant should provide supporting
documentation to justify any change and submit the request to the
Commander, US Army PERSCOM, ATTN:  TAPC-EPR-P, 2461 Eisenhower Avenue,
Alexandria, Virginia  22331-0450.

        (2)  The issue is rejected.  See issue (3) above.
