      After careful review of your application, military records and all
other available evidence, the Army Discharge Review Board determined that
you were properly and equitably discharged.  Accordingly, your request for
a change in the character and/or reason of your discharge is denied.

      You may reapply to the Army Discharge Review Board for a personal
appearance hearing and/or you may apply to the Army Board for Correction of
Military Records.  Enclosed are the necessary applications for requesting a
review from both boards.  If you choose to apply to the Army Board for
Correction of Military Records you must do so within three years from the
date of this letter.

      Be advised that the Army Discharge Review Board operates on a 15-year
statute of limitations from the date of discharge; therefore, you must
reapply within this time frame for a hearing.

      If you believe that the decision in your case is unclear, not
responsive to the issues raised, or does not otherwise agree with the
decisional document requirements of DoD Directive 1332.28, you may submit a
complaint in accordance with Enclosure 5 of that Directive.  The complaint
procedure does not permit you to challenge the merits of the decision, but
is designed solely to ensure that the decisional document meets applicable

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The evidence of record shows that on 21 February 1991, the
applicant was charged with AWOL (910203-911112).  On 21 November 1991, the
applicant consulted with legal counsel and voluntarily requested, in
writing, discharge under the provisions of Chapter l0, AR 635-200 in lieu
of trial by court-martial.  In this request, the applicant admitted guilt
to the offense, or a lesser-included offense.  Further, the applicant
indicated that he understood that he could receive an under other than
honorable conditions discharge and that the discharge would have a
significant effect on eligibility for veteran’s benefits.  The applicant
submitted a statement in his own behalf.  The unit commander recommended
approval of an uncharacterized discharge.  On 5 February 1992, the
separation authority approved the discharge with service uncharacterized.

      b.  On 11 March 1992, the applicant was discharged.  At the time of
discharge, the applicant had completed 4 months and 12 days of active
military service (to include 107 days excess leave) and accrued 275 days of
lost time due to AWOL in the period under review and had a total of 3
years, 1 month and 6  days of military service.

      c.  In accordance with National Guard Regulation 600-200, the New
York Army National Guard ceded jurisdiction to the Active Army and
discharged the applicant on 5 March 1991.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt.  Army policy states
that although an honorable or general discharge is authorized, a discharge
UOHC is normally considered appropriate.

        (1)  The issue is rejected.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infraction of discipline, the extent thereof, and the
seriousness of the offense.  The Board noted that because the applicant was
in an entry-level status at the time of his AWOL, the approving authority
had only two options as to characterization of service.  One option was to
characterize the applicant’s service as under other than honorable
conditions and the other was not to characterize the applicant’s service.
Because the applicant was in an entry-level status, and presented
mitigating circumstances at the time of his separation, he was given an
uncharacterized discharge.  A fully honorable discharge may be granted only
in cases which are clearly warranted by unusual circumstances involving
outstanding personal conduct and/or performance of duty.  The Board
determined that no such unusual circumstances were present in the
applicant’s record and his service did not warrant an honorable discharge.
The Board, being convinced that the reason for discharge and the
characterization of service were both proper and equitable, voted to deny
relief.
