      After careful review of your application, military records and all
other available evidence, the Army Discharge Review Board determined that
you were properly and equitably discharged.  Accordingly, your request for
a change in the character and/or reason of your discharge is denied.

      You may reapply to the Army Discharge Review Board for a personal
appearance hearing and/or you may apply to the Army Board for Correction of
Military Records.  Enclosed are the necessary applications for requesting a
review from both boards.  If you choose to apply to the Army Board for
Correction of Military Records you must do so within three years from the
date of this letter.

      Be advised that the Army Discharge Review Board operates on a 15-year
statute of limitations from the date of discharge; therefore, you must
reapply within this time frame for a hearing.

      If you believe that the decision in your case is unclear, not
responsive to the issues raised, or does not otherwise agree with the
decisional document requirements of DoD Directive 1332.28, you may submit a
complaint in accordance with Enclosure 5 of that Directive.  The complaint
procedure does not permit you to challenge the merits of the decision, but
is designed solely to ensure that the decisional document meets applicable
requirements for clarity and responsiveness.  You may obtain a copy of DoD

                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 17 September 1998, State of
Ohio, Adjutant General’s Department, Columbus, Ohio, Orders 179-050
discharged the applicant from the Ohio Army National Guard and assigned him
to the Army Reserve, effective 15 June 1998.  The record contains a
properly constituted NGB Form 22 (Report of Separation and Record of
Service).  His NGB Form 22 indicates that he was discharged under the
provisions of Chapter 8-27f, NGR 600-200, by reason of unsatisfactory
participation.  This document also shows that the applicant was not
available to sign his report of separation and that it was mailed to his
last known address.  The specific facts and circumstances pertaining to the
applicant’s discharge are not contained in the available records.

      b.  On 15 June 1998, the applicant was discharged from the Ohio Army
National Guard and transferred to the Army Reserve.  At the time of
discharge, the applicant had completed 2 years, 11 months, and 23 days of
military service in the period under review and had a total of 5 years, 4
months and 17 days of military service.  The terminal date of
reserve/military service obligation was shown as 1 December 2001.  On 26
March 2002, the applicant was honorably discharged from the Army Reserve
upon completion of his military service obligation.

2.  Legal/Regulatory Basis for Separation Action:  National Guard
Regulation (NGR) 600-200 and Army Regulation 135-91 govern procedures
covering enlisted personnel management of the Army National Guard.  Chapter
8 of NGR 600-200 covers, in pertinent part, reasons for discharge and
separation of enlisted personnel from the State Army Reserve National
Guard.  Paragraph 8-27f of that regulation provides in pertinent part that
individuals can be separated for being an unsatisfactory participant.  Army
Regulation 135-91 states that a member is an unsatisfactory participant
when nine or more unexcused absences from scheduled drills occur during a 1
year period.

regularity in the discharge process.  The Board, being convinced that the
