      After careful review of your application, military records and all
other available evidence, the Army Discharge Review Board determined that
you were properly and equitably discharged.  Accordingly, your request for
a change in the character and/or reason of your discharge is denied.

      You may reapply to the Army Discharge Review Board for a personal
appearance hearing and/or you may apply to the Army Board for Correction of
Military Records.  Enclosed are the necessary applications for requesting a
review from both boards.  If you choose to apply to the Army Board for
Correction of Military Records you must do so within three years from the
date of this letter.

      Be advised that the Army Discharge Review Board operates on a 15-year
statute of limitations from the date of discharge; therefore, you must
reapply within this time frame for a hearing.

                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 20 march 2001, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter l4, AR 635-200, by reason of
misconduct—commission of a serious offense, with an uncharacterized
discharge.  The unit commander indicated that he was initiating separation
proceedings based on the applicant’s wrongful use of marijuana.  He was
advised of his rights.  The applicant waived his right to consult with
legal counsel, was advised of the impact of the discharge action, and did
not submit a statement in his own behalf.  The unit commander subsequently
recommended separation from the service and waiver of further
rehabilitative efforts.  The intermediate commander reviewed the proposed
discharge action and recommended approval of the separation action with a
general, under honorable conditions discharge.  On undated, the separation
authority waived further rehabilitative efforts and directed that the
applicant be discharged with an uncharacterized discharge.

      b.  On 30 March 2001, the applicant was discharged.  At the time of
discharge, the applicant had completed 5 months and 26 days of active
military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct.  Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave.  Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed.  Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.  An uncharacterized discharge may be given if an individual
is in entry-level status.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

      b.  Equity:      The parenthetical number(s) below correspond(s) to
                   the issue number(s) on the DD Form 293, or in Part VI,
                   Paragraph 1, above.

        (1)  The issue is rejected.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  The commission of a serious offense (using
and possessing marijuana) compelled the applicant’s command to consider him
for separation.  Retention is normally only considered in exceptionally
meritorious cases when clearly in the best interests of the Army.  The
applicant provided no independent corroborating evidence demonstrating that
either the command's action was erroneous or that his service mitigated the
misconduct or poor duty performance.  The applicant’s service was
uncharacterized because he was in entry-level status, i.e., less than l80
days continuous active duty at the time his commander initiated separation
action.  An uncharacterized characterization of service denotes only that
the individual had less than l80 days on active duty.  The applicant was
not entitled to a Chapter 11, Entry Level Performance and Conduct discharge
because that type of discharge is reserved for those individuals who are
found to lack the necessary motivation, adaptability, self-discipline,
ability, or attitude to become productive soldiers.  The applicant’s
serious misconduct disqualified him from receiving this type of discharge.
The Board found no evidence of arbitrary or capricious actions by the
command.  The Board was satisfied that all requirements of law and
regulation were met and the rights of the applicant were fully protected
throughout the separation process.  The Board, being convinced that the
reason for discharge and the characterization of service were both proper
and equitable, voted to deny relief.
