                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The facts and circumstances pertaining to the applicant’s
discharge are not contained in the available records.  On 7 January 1997,
the State of California, Office of the Adjutant General, Sacramento,
California, discharged the applicant from the Army National Guard,
effective 30 October 1996, with a general, under honorable conditions
discharge and reassigned him to the USAR Control Group (Reinforcement), St
Louis, Missouri to complete his contractual obligation.  The record
contains a properly constituted NGB Form 22 (Report of Separation and
Record of Service).  It indicates that the applicant was discharged under
the provisions of Paragraph 8-27g, NGR 600-200, by reason of unsatisfactory
participant, with a characterization of service of general, under honorable
conditions, and a Reenlistment Eligibility Code of RE 3.

      b.  On 30 October 1996, the applicant was discharged and reassigned
to the USAR Control Group (Reinforcement), St Louis, Missouri.  At the time
of discharge, the applicant had completed 12 years, 10 months, and 16 days
of military service in the period under review and had a total of 26 years
and 26 days of total military service.

      c.  The applicant’s NGB Form 22 appears to be incorrect.  It does not
include his prior National Guard service for the period 15 May 1977 – 14
December 1983, totaling 6 years and 7 months.

2.  Legal/Regulatory Basis for Separation Action:  National Guard
Regulation (NGR) 600-200 and Army Regulation 135-91 govern procedures
covering enlisted personnel management of the Army National Guard.  Chapter
8 of NGR 600-200 covers, in pertinent part, reasons for discharge and
separation of enlisted personnel from the State Army Reserve National
Guard.  Paragraph 8-27(f) of that regulation provides in pertinent part
that individuals can be separated for being an unsatisfactory participant.
Army Regulation 135-91 states that a member is an unsatisfactory
participant when nine or more unexcused absences from scheduled drills
occur during a 1 year period.

      a.  Propriety:   The parenthetical number(s) below correspond(s) to
                   the issue number(s) on the DD Form 293, or in Part VI,

        (1)  The issue is rejected.  The applicant’s record is void of the
specific facts and circumstances concerning the events that led to a
discharge from the State of California Army National Guard and transfer to
the United States Army Reserve Control Group (Reinforcement).  However, the
available records contain a properly constituted NGB Form 22E (Report of
Separation and Record of Service).  This document identifies the reason and
characterization of the discharge and the Board presumed Government
regularity in the discharge process.  The evidence of record shows the
applicant was discharged under the provisions of Chapter 8, Paragraph 8-
27g, NGR 600-200, by reason of unsatisfactory participation with a general,
under honorable conditions characterization of service.  The Board noted
the applicant’s contentions; however, the applicant has provided no
independent corroborating evidence demonstrating that either the command's
action was erroneous or that the applicant’s service mitigated the
misconduct or poor duty performance.  In the absence of corroborated
evidence to the contrary, the Board was satisfied that all requirements of
law and regulation were met and the rights of the applicant were fully
protected throughout the separation process.  The Board, being convinced
that the reason for discharge and the characterization of service were both
proper and equitable, voted to deny relief.

      b.  Equity:      The applicant has not submitted an issue of equity
                   and the ADRB has not otherwise relied upon an issue of
                   equity to change the discharge.  The major factors upon
                   which the discharge was based are set forth in Parts III
                   and IV of this decisional document.
