                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 10 December 2001, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter l3, AR 635-200, by reason of unsatisfactory
performance, with a general, under honorable conditions discharge.  The
unit commander indicates that the reasons for initiation of the proposed
action was the applicant’s Company Grade Article 15 (i.e., never imposed
and or completed) for disrespect to a noncommissioned officer and failure
to be at her appointed place of duty; and several counseling statements.
On 11 December 2001, the applicant waived her right to consult with legal
counsel, was advised of the impact of the discharge action, and did not
submit a statement in her own behalf.  The unit commander subsequently
recommended separation from the service and waiver of further
rehabilitative efforts.  On 19 December 2001, the separation authority
directed that the applicant be discharged with a characterization of
service of general, under honorable conditions.

      b.  On 14 January 2002, the applicant was discharged.  At the time of
discharge, the applicant had completed 2 years, 3 months, and 7 days of
active military service in the period under review and had a total of 4
years, 5 months, and 2 days of total military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 13 contains the policy and outlines the procedures for separating
individuals for unsatisfactory performance, and provides, in pertinent
part, that commanders will separate a member under this chapter when, in
the commander's judgment, the member will not develop sufficiently to
participate satisfactorily in further training and/or become a satisfactory
soldier.  Army policy states that a general discharge, under honorable
conditions is normally considered appropriate, but an honorable discharge
may be granted in meritorious cases.

        (2)  The issue is accepted.  The evidence of record shows that the
applicant’s unit commander initiated the applicant’s separation action
based on a company grade Article 15 that was never imposed and or
completed.  Additionally, the unit commander included said Article 15 as an
enclosure to the discharge packet.  In view of the foregoing, the Board
determined that the discharge was and is improper.  Accordingly, the Board
voted to grant full relief in the form of an upgrade of characterization of
service to fully honorable and a change to the narrative reason for
separation to Secretarial Authority.  This action entails a change to the
reentry eligibility (RE) code to “1.”
