PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 7 March 2002, the unit commander
notified the applicant of initiation of separation action under the
provisions of Chapter l3, AR 635-200, by reason of unsatisfactory
performance, with a general, under honorable conditions discharge. The
reasons for the proposed action were he received a Company Grade Article 15
for disobeying a noncommissioned officer; a vacation of suspension for
breaking restriction; a Company Grade Article 15 for breaking restriction;
and unsatisfactory performance counseling statements. On 12 March 2002,
the applicant consulted with legal counsel, was advised of the impact of
the discharge action, and did not submit a statement in his own behalf.
The unit commander subsequently recommended separation from the service and
waiver of further rehabilitative efforts. On 18 March 2002, the separation
authority waived further rehabilitative efforts and directed that the
applicant be discharged with a characterization of service of general,
under honorable conditions.
b. On 28 March 2002, the applicant was discharged. At the time of
discharge, the applicant had completed 1 year, 5 months, and 25 days of
active military service in the period under review.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 13 contains the policy and outlines the procedures for separating
individuals for unsatisfactory performance, and provides, in pertinent
part, that commanders will separate a member under this chapter when, in
the commander's judgment, the member will not develop sufficiently to
participate satisfactorily in further training and/or become a satisfactory
soldier. Army policy states that a general discharge, under honorable
conditions is normally considered appropriate, but an honorable discharge
may be granted in meritorious cases.

(1) The issue is rejected. The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as the incidents of unsatisfactory performance, the extent thereof,
and the seriousness of the incidents. The evidence of record does not
support the applicant’s contentions and the applicant has provided no
independent corroborating evidence in support of his contentions. The
evidence of record shows that the command attempted to assist the applicant
in performing and conducting himself to Army standards by providing
counseling and by the imposition of nonjudicial punishment. The applicant
failed to respond appropriately to these efforts. Before initiating action
to separate the applicant, the command ensured the applicant was
appropriately counseled about the deficiencies, which could lead to
separation. The Board noted the command made an assessment of the
applicant's potential for becoming a fully satisfactory soldier. The
evidence of record established that the applicant was afforded a reasonable
opportunity to overcome noted deficiencies. As the applicant did not
subsequently conform to required standards of discipline and performance,
the command appropriately determined the applicant did not demonstrate the
potential for further military service. The Board found no evidence of
arbitrary or capricious actions by the command. The Board was satisfied
that all requirements of law and regulation were met and the rights of the
applicant were fully protected throughout the separation process. The
Board, being convinced that the reason for discharge and the
characterization of service were both proper and equitable, voted to deny
relief.
b. Equity: The applicant has not submitted an issue of equity
and the ADRB has not otherwise relied upon an issue of
equity to change the discharge. The major factors upon
which the discharge was based are set forth in Parts III
and IV of this decisional document.
