                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 14 November 2000, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter l4, AR 635-200, by reason of
misconduct—commission of a serious offense-abuse of illegal drugs, with an
under other than honorable conditions discharge.  The reasons for the
proposed action were he received a Field Grade Article 15 for wrongful
possession of a controlled substance; unlawfully carrying two concealed
weapons; and driving on post when his driving privileges were suspended.
Additionally, the unit commander included the following incidents of
misconduct:  failure to pay just debts; positive urinalysis; disobeying an
order; and six incidents of failure to repair.  On 15 November 2000, the
applicant consulted with legal counsel, was advised of the impact of the
discharge action, and did not submit a statement in his own behalf.  He
also voluntarily waived consideration of his case by an administrative
separation board contingent on receiving a characterization of service no
less favorable than general, under honorable conditions.  On 16 November
2000, the unit commander subsequently recommended separation from the
service and waiver of further rehabilitative efforts.  The intermediate
commanders reviewed the proposed discharge action and recommended approval
of the separation action with an under other than honorable conditions
discharge.  On 27 December 2000, the separation authority disapproved the
applicant’s conditional waiver and referred his case to an administrative
separation board.  On 7 February 2001, the applicant acknowledged receipt
of the notification to appear before an administrative separation board.
However, due to unknown reasons, the board was delayed.  On 1 March 2001,
the applicant acknowledged receipt of the rescheduled date.  On 8 March
2001, an administrative separation board conducted the proceedings in the
applicant’s case.  The applicant was present with his defense counsel.
Based on its findings, the Board recommended separation with a
characterization of service of under other than honorable conditions.  On
12 April 2001, the proper legal authority concurred with the board’s
findings and recommendations.  On 12 April 2001, the separation authority
approved the Board’s findings and recommendations, waived further
rehabilitative efforts, and directed the discharge of the applicant with a
characterization of service of under other than honorable conditions.

      b.  On 25 April 2001, the applicant was discharged.  At the time of
discharge, the applicant had completed 2 years, 11 months, and 5 days of
active military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct.  Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave.  Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed.  Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

        (1)  The issue is rejected.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  The Board noted the applicant’s contentions;
however, did not find said contentions sufficiently mitigating to warrant
an upgrade of the discharge under review.  The Board determined that the
applicant's discharge was appropriate because the quality of his service
was not consistent with the Army's standards for acceptable personal
conduct and performance of duty by military personnel.  By his misconduct
and poor duty performance, the applicant diminished the quality of his
service below that meriting a fully honorable or general discharge.  The
applicant provided no independent corroborating evidence demonstrating that
either the command's action was erroneous or that the applicant’s service
mitigated the misconduct or poor duty performance.  The Board, being
convinced that the reason for discharge and the characterization of service
were both proper and equitable, voted to deny relief.
