SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The specific facts and circumstances pertaining to the
applicant’s discharge are not contained in the available records. The
record contains a properly constituted DD Form 214 (Certificate of Release
or Discharge from Active Duty), which was authenticated by the applicant’s
signature. His DD Form 214 indicates that he was discharged under the
provisions of Chapter 5, Paragraph 5-17, AR 635-200 by reason of physical
condition, not a disability, with a characterization of service of
honorable.
b. On 12 August 2002, the applicant was discharged. At the time of
discharge, the applicant had completed 1 year, 3 months, and 4 days of
active military service in the period under review.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
provides the basic authority for the separation of enlisted personnel.
Paragraph 5-17 provides that a soldier may be separated for a physical or
mental condition, not amounting to disability under Army Regulation 635-40
that interferes with assignment to or performance of duty. Army policy
states that an honorable or general discharge is authorized depending on
the applicant’s overall record of service, unless the soldier is in an
entry-level status. The service of soldiers in an entry-level status will
be uncharacterized. A soldier is in an entry-level status if the soldier
has not completed more than 180 days of creditable continuous active duty
prior to the initiation of separation action.

a. Propriety: The parenthetical number(s) below correspond(s) to

(1) The issue is rejected. The applicant’s record is void of the
specific facts and circumstances concerning the events that led to a
discharge from the Army. However, the applicant’s record contains a
properly constituted DD Form 214 (Certificate of Release or Discharge from
Active Duty), which was authenticated by the applicant’s signature. This
document identifies the reason and characterization of the discharge and
the Board presumed Government regularity in the discharge process. The
evidence of record shows the applicant was discharged under the provisions
of Chapter 5, Paragraph 5-17, AR 635-200, by reason of a physical
condition, not a disability with a characterization of service of
honorable. The Board noted the applicant’s contentions and supporting
documents; however, did not find said contentions or documents sufficiently
mitigating to overcome its presumption of regularity in the discharge
process. In the absence of corroborated information to the contrary, the
Board was satisfied that all requirements of law and regulation were met
and the rights of the applicant were fully protected throughout the
separation process. The Board, being convinced that the reason for
discharge and the characterization of service were both proper and
equitable, voted to deny relief.
b. Equity: The applicant has not submitted an issue of equity
and the ADRB has not otherwise relied upon an issue of
equity to change the discharge. The major factors upon
which the discharge was based are set forth in Parts III
and IV of this decisional document.
