                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 12 March 1991, the applicant, in
a signed statement, requested an administrative separation after admitting
that she had homosexual tendencies and had engaged in sexual activity with
a civilian member of the same sex.  On 27 March 1991, the unit commander
interviewed the applicant, at which time she verbally admitted the same.
On 17 April 1991, the unit commander notified the applicant of initiation
of separation action under the provisions of Chapter l5, AR 635-200, by
reason of homosexual admission, with an honorable discharge.  She was
advised of her rights.  On 17 April 1991, the applicant consulted with
legal counsel, was advised of the impact of the discharge action, and did
not submit a statement in her own behalf.  She conditionally waived her
right to have her case considered by an administrative separation board
contingent upon receiving a characterization of service no less favorable
than honorable.  The unit and interim commanders subsequently recommended
separation with an honorable discharge.  On 30 April 1991, the separation
authority disapproved her conditional waiver and referred her case to an
administration separation board.  On 16 May 1991, after further
consultation with her attorney, she submitted an unconditional waiver of
her right to appear before a board and to have a board consider her case.
On 30 May 1991, the separation authority directed that the applicant be
discharged with a characterization of service of general, under honorable
conditions and separation code (SPD) of “JRA” (i.e., engaged in homosexual
acts).

      b.  On 6 June 1991, the applicant was discharged.  At the time of
discharge, the applicant had completed 3 years, 2 months, and 28 days of
active military service in the period under review.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 15 of that regulation states that active homosexuality is
incompatible with military service and provides, in pertinent part, for the
separation of members who actively engage in homosexual conduct or who, by
their statements, demonstrate a tendency to engage in homosexual conduct.
Army regulation states that when the sole basis for separation is
homosexuality, a discharge under other than honorable conditions may be
issued only if such characterization is warranted in accordance with
chapter 3, section III, and if there is a finding that during the current
term of service the soldier attempted, solicited, or committed a homosexual
act by using force, coercion or intimidation; with a person under 16 years
of age; with a subordinate in circumstances that violate customary military
superior subordinate relationships; openly in public view; for
compensation; aboard a military vessel or aircraft; or in another location
subject to military control if the conduct had, or was likely to have had,
an adverse impact on discipline, good order, or morale due to the close
proximity of other soldiers of the Armed Forces.  In all other cases, the
type of discharge will reflect the character of the soldier’s overall
record of service.

applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as her self-admitted homosexual conduct in her barracks dorm room.
Notwithstanding the propriety of the applicant’s discharge for having
engaged in homosexual act(s), the Board determined that the
characterization of service is inequitable.  The Board found that the
applicant’s inappropriate conduct was mitigated by service of sufficient
merit and the recommendations of her immediate chain of command.
Accordingly, the Board voted to grant partial relief by changing the
characterization of service to fully honorable.  However, the Board found
that the reason for discharge was both proper and equitable and voted not
to change it.
