                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The specific facts and circumstances leading to the applicant’s
discharge are not contained in the available records.  Evidence of record
shows that on 17 June 1982, Orders 169-722, DA, United States Army Infantry
Center, Fort Benning, Georgia, discharged the applicant from the regular
Army, effective date: 26 June 1992.  The record contains a properly
constituted DD form 214 (Certificate of Release or Discharge from Active
Duty), which was authenticated by the applicant’s signature.  His DD Form
214 indicates that he was discharged under the provisions of Chapter 13, AR
635-200, by reason of unsatisfactory performance, with a characterization
of service of general, under honorable conditions.  Furthermore, the DD
Form 214 shows a Separation Code of JHJ (i.e., unsatisfactory performance).


      b.  On 26 June 1992, the applicant was discharged.  At the time of
discharge, the applicant had completed 3 years, 8 months, and 21 days of
active military service in the period under review and had a total of 5
years, 1 month, and 6 days of total military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 13 contains the policy and outlines the procedures for separating
individuals for unsatisfactory performance, and provides, in pertinent
part, that commanders will separate a member under this chapter when, in
the commander's judgment, the member will not develop sufficiently to
participate satisfactorily in further training and/or become a satisfactory
soldier.  Army policy states that a general discharge, under honorable
conditions is normally considered appropriate, but an honorable discharge
may be granted in meritorious cases.

        (2)  The issue is accepted.  The Board carefully examined the
available records for the period of enlistment under review.  The available
records show that the applicant served 3 years, 8 months, and 21 days of
his 4-year enlistment.  The record further shows that he attained the grade
of E4 and served overseas for over 1 year and 11 months.  Notwithstanding
the fact that the applicant was discharge under the provisions of Chapter
13, AR 635-200 by reason of unsatisfactory performance, the Board
determined that based on the overall length and quality of his service and
the time that has elapsed since his discharge, that the characterization of
service is now inequitable.  Accordingly, the Board voted to grant relief
by changing the characterization of service to fully honorable.  However,
the Board found that the reason for discharge was both proper and equitable
and voted not to change it.
