                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The evidence of record shows that on 7 October 1991, the
applicant was charged with AWOL (911002-911004); failing to go to
formation; failing to follow a lawful command from an officer; and breaking
restriction.  On 8 October 1991, the applicant consulted with legal counsel
and voluntarily requested, in writing, discharge under the provisions of
Chapter l0, AR 635-200 in lieu of trial by court-martial.  In this request,
the applicant admitted guilt to the offenses, or  lesser-included offenses.
 Further, the applicant indicated that he understood that he could receive
an under other than honorable conditions discharge and that the discharge
would have a significant effect on eligibility for veteran’s benefits.  The
applicant did not submit a statement in his own behalf.  The unit commander
recommended approval of an under other than honorable conditions discharge.
 On 28 October 1991, the separation authority approved the discharge with
an under other than honorable conditions discharge.  The applicant was to
be reduced to the lowest enlisted rank.

      b.  On 1 November 1991, the applicant was discharged.  At the time of
discharge, the applicant had completed 1 year, 6 months, and 17 days of
active military service and accrued 27 days of lost time due to AWOL and
military confinement in the period under review and had a total of 10
years, 1 month and 2 days of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt.  Army policy states
that although an honorable or general discharge is authorized, a discharge
UOHC is normally considered appropriate.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

      b.  Equity:      The parenthetical number(s) below correspond(s) to

                   Paragraph 1, above.

        (4)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  The Board does not condone the applicant’s
misconduct; however, it determined that the nature of the applicant's
misconduct did not rise to a level warranting the issuance of a
characterization of service of under other than honorable conditions.  The
applicant served for over ten years, to include combat service in Southwest
Asia, attained the grade of staff sergeant/E-6, received four Army
Achievement Medals, and three Good Conduct Medals.  His infractions of
discipline transpired during his last month of service and appear to have
been an aberration in an otherwise exemplary record of service.
Additionally, the applicant’s infractions were mitigated by mental and
personal problems beyond the applicant’s control.  Given the above, the
Board found that the applicant’s discharge was inequitable.  Accordingly,
the Board voted to grant relief in the form of an upgrade of
characterization of service to fully honorable and to change the reason for
discharge to Secretarial Authority.  This action does not entail a change
in RE code.
