                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 19 November 2002, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter l4, AR 635-200, by reason of misconduct—patterns
of misconduct, with a general, under honorable conditions discharge.  The
unit commander indicated that he was initiating separation proceedings
because the applicant was disrespectful in deportment and language to
noncommissioned officers on several occasions; willfully disobeyed orders;
and, failed to go to his appointed place of duty on several occasions.  He
was advised of his rights.  The applicant consulted with legal counsel, was
advised of the impact of the discharge action, requested appearance before
an administrative board, and did not submit a statement in his own behalf.
On 22 November 2002, the applicant submitted a conditional waiver for an
administrative separation board contingent upon receiving an honorable
discharge.  The unit commander subsequently recommended separation from the
service and waiver of further rehabilitative efforts.  The intermediate
commander reviewed the proposed discharge action and recommended approval
of the separation action with a general, under honorable conditions
discharge.  On 6 December 2002, the separation authority waived further
rehabilitative efforts and directed that the applicant be discharged with a
characterization of service of general, under honorable conditions.

      b.  On 6 January 2003, the applicant was discharged.  At the time of
discharge, the applicant had completed 10 months and 2 days of active
military service in the period under review and had a total of 6 years, 6
months and
9 days of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct.  Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave.  Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed.  Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

Chapter 2, AR 635-200, prescribes procedures for notifying individuals that
he/she has been recommended for separation from the Army.  Paragraph 2-
2c(4), in pertinent part, states that an individual is entitled to an
administrative separation board if he/she had 6 or more years of total
active and reserve service on the date of initiation of recommendation for
separation.  This includes creditable service in any U.S. military
component, for example, RA, ARNGUS, USAR (including IRR), USN, USAF, and so
forth.

        (7)  The issue is accepted.  The Board noted that at the time of
notification of discharge the applicant had completed 6 years, 4 months,
and 21 days of total military service and was entitled to have his case
considered by an administrative separation board.  There is no evidence in
the record showing that the applicant received effective notification of
this right or that he had the opportunity to appear before an
administrative separation board.  In view of the foregoing, the Board
determined that the discharge was improper.  Accordingly, the Board voted
to grant full relief by changing the characterization of service to
honorable and changing the narrative reason for separation to Secretarial
Authority.  This action entails a change in RE code to 1.
