PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The evidence of record shows that on 8 January 1993, the
applicant was charged with failing to go to his appointed place of duty,
two specifications; (921224); (921226); wrongfully using marijuana between
(921102-921202); wrongfully using cocaine between (921125-921202) and
breaking restriction (921224). On 18 February 1993, the applicant
consulted with legal counsel and voluntarily requested, in writing,
discharge under the provisions of Chapter l0, AR 635-200 in lieu of trial
by court-martial. In this request, the applicant admitted guilt to the
offense, or a lesser included offense. Further, the applicant indicated
that he understood that he could receive an under other than honorable
conditions discharge and that the discharge would have a significant effect
on eligibility for veteran’s benefits. The applicant submitted a statement
in his own behalf. The unit commander and intermediate commanders
recommended approval of an under other than honorable conditions discharge.
On 22 February 1993, the separation authority approved the discharge with
an under other than honorable conditions discharge. The applicant was to
be reduced to the lowest enlisted rank.
b. On 25 February 1993, the applicant was discharged. At the time
of discharge, the applicant had completed 2 years, 7 months, and 21 days of
active military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt. Army policy states
that although an honorable or general discharge is authorized, a discharge
under other than honorable conditions is normally considered appropriate.

a. Propriety: The applicant has not submitted an issue of
propriety and the ADRB has not otherwise relied upon an
issue of propriety to change the discharge.

(2) The issue is accepted. The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses. While the Board does not condone the
applicant’s misconduct, it determined that the characterization of service
was inequitable. The Board found that the applicant’s misconduct was
mitigated by the length and quality of his service, to include his combat
service, and post service accomplishments. Accordingly, the Board voted to
grant partial relief in the form of an upgrade of characterization of
service to general, under honorable conditions. However, the Board was
satisfied that the reason for discharge was both proper and equitable, and
voted not to change it.
(1) The issue is rejected. The evidence of record shows the
applicant was charged with the commission of an offense punishable under
the Uniform Code of Military Justice (UCMJ) with a punitive discharge. The
Board noted, after consulting with defense counsel, the applicant
voluntarily, and in writing, requested separation from the Army in lieu of
trial by court-martial. In doing so, the applicant admitted guilt to the
stipulated or lesser-included offenses under the UCMJ. (See response to
