PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 14 November 2000, the applicant
was charged with wrongfully communicating indecent language towards PV2,
two specifications (001011) and (001012); wrongfully sending an indecent
message to PV2 (001018); making a false statement to Special Agent
(001023); committing sodomy with PV2 (001020); committing an indecent
assault upon PV2 (001020); wrongfully endeavoring to impede an
investigation by asking PV2 to make a false statement (001020); making an
official statement which was false to a CW2 (001020); and violating a
lawful general regulation by wrongfully having a personal relationship with
PV2 (001020). On 20 November 2000, the applicant voluntarily tendered his
resignation from the service under the provisions of Chapter 3, AR 600-8-
24, resignation for the good of the Service in lieu of trial by a court-
martial. The chain of command recommended approval of the resignation for
the good of the service with issuance of an under other than honorable
conditions discharge. On 11 May 2001, the Deputy Assistant Secretary (Army
Review Boards) approved the recommendation of the Army Ad Hoc Review Board
and directed that the applicant be discharge with a characterization of
service of under other than honorable conditions.
b. On 27 June 2001, the applicant was discharged. At the time of
discharge, the applicant had completed 2 years, 10 months, and 24 days of
active military service in the period under review and had a total of 15
years, 9 months, and
9 days of active military service.
2. Legal/Regulatory Basis for Separation Action: Army regulation 600-8-24
prescribes the policies and procedures governing the transfer and discharge
of Army officer personnel. Chapter 3, Paragraph 3-13 outlines the rules
for processing request for resignation for the good of the Service in lieu
of trial by a general court-martial.

(2) The issue is accepted. The Board carefully examined the
applicant’s record during the period of service under review and heard his
testimony. There was a full consideration of all faithful and honorable
service as well as the infractions of discipline, the extent thereof, and
the seriousness of the offenses. The Board found that the length and
quality of the applicant’s service partially mitigated his misconduct. In
addition, the applicant has provided evidence of favorable post-service
conduct and the Board found that the characterization of service granted is
now inequitable. Accordingly, the Board voted to grant relief in the form
of an upgrade of characterization of service to general, under honorable
conditions. The Board determined that the reason for discharge was proper
and equitable and voted not to change it.
