                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  The evidence of record shows that the applicant was charged with
one specification of desertion with intent to avoid hazardous duty (18-19
Mar 2003) and one specification of missing movement through design (19
March 2003).  On 2 May 2003, the applicant consulted with civilian legal
counsel and voluntarily requested, in writing, discharge under the
provisions of Chapter l0, AR 635-200 in lieu of trial by court-martial.  In
this request, the applicant admitted guilt to the offense, or a lesser
included offense.  Further, the applicant indicated that he understood that
he could receive an under other than honorable conditions discharge and
that the discharge would have a significant effect on eligibility for
veteran’s benefits.  The applicant submitted a statement in his own behalf.
 His legal counsel also submitted a statement on behalf of his client.  The
unit commander’s recommendation is not contained in the available records.
On 7 May 2003, the separation authority approved the discharge with an
under other than honorable conditions discharge and reduction to Private
E1.

      b.  On 16 May 2003, the applicant was discharged.  At the time of
discharge, the applicant had completed 1 year, 2 months, and 9 days of
active military service and accrued two (2) days of lost time in the period
under review.  He had a total of 6 years, 10 months, and 4 days of total
military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt.  Army policy states
that although an honorable or general discharge is authorized, a discharge
under other than honorable conditions is normally considered appropriate.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

      b.  Equity:      The parenthetical number(s) below correspond(s) to

                   Paragraph 1, above.

        (5)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review
and heard his testimony.  There was a full consideration of all faithful
and honorable service as well as the infractions of discipline, the extent
thereof, and the seriousness of the offenses.  While the Board does not
condone the applicant’s misconduct, it determined that the characterization
of service was inequitable.  The Board found that the applicant’s
misconduct was mitigated by physical and psychological problems that
impaired his ability to serve and the overall length and quality of his
service.  Accordingly, the Board voted to grant partial relief in the form
of an upgrade of characterization of service too general, under honorable
conditions.  The Board determined that the reason for discharge was proper
and equitable and voted not to change it.

        (1-4)  The issues are rejected.  The applicant’s misconduct
diminished the quality of his service below that meriting a fully honorable
discharge.  A change to the reentry eligibility (RE) code does not fall
within the purview of this Board.  Based on the applicant’s narrative
reason for separation the Board determined that he was properly assigned an
RE Code of “4.”  See response to issue 5 above.
