SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The specific facts and circumstances leading to the applicant’s
discharge are not in the available records. The record contains a properly
constituted DD Form 214 (Certificate of Release or Discharge from Active
Duty). His DD Form 214 indicates that he was involuntarily discharged
under the provisions of Chapter 14, paragraph 14-12c, AR 635-200 by reason
of misconduct, with a characterization of service of general, under
honorable conditions, with a separation code of JKQ (i.e., commission of a
serious offense), and an RE code of 3.
b. On 14 April 2003, the applicant was discharged. At the time of
discharge, the applicant had completed 3 years, 2 months, and 24 days of
active military service and accrued 566 days of lost time in the period
under review and had a total of 12 years, 7 months, and 23 days of total
military service.
c. In a 3 January 2002, MFR, from the Commander, B Company, 3rd
Battalion, 7th Special Forces Group, Fort Bragg, NC, he indicated the
applicant was accused of a felony (attempted murder) and was not released
on bond due to the strong evidence against him. Lost time (010828-030414)
on DD Form 214 is most likely due to confinement by civil authorities.
Since it appears that the applicant was still in civil confinement at the
time of his discharge, there is no evidence showing the resolution of his
case.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct. Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave. Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed. Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.
