SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. Evidence of record shows that on 3 March 2000, the unit commander
notified the applicant of initiation of separation action under the
provisions of Chapter l4, AR 635-200, by reason of misconduct—commission of
a serious offense, with an under other than honorable conditions discharge.
He was advised of his rights. The applicant consulted with legal counsel,
was advised of the impact of the discharge action, requested consideration
of his case by an administrative separation board and submitted a statement
in his own behalf. The unit commander subsequently recommended separation
from the service and waiver of further rehabilitative efforts. The
intermediate commander reviewed the proposed discharge action and
recommended approval of the separation action with an under other than
honorable conditions discharge. On 9 May 2000, the administrative
separation board met; applicant appeared with counsel. The Board
recommended separation from the service with an under other than honorable
conditions discharge. On 25 May 2000, the separation authority approved
the findings and recommendations of the board and directed that the
applicant be discharged with a characterization of service of under other
than honorable conditions.
b. On 23 June 2000, the applicant was discharged. At the time of
discharge, the applicant had completed 2 years, 3 months, and 29 days of
active military service in the period under review and had a total of 17
years, and 1 month of active military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct. Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave. Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed. Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

(2) The issue is accepted. The Board noted that the government
introduced a document into the discharge process revealing that the
applicant had self-referred to the Alcohol and Drug Prevention and Control
Program for substance abuse. This is limited use information as defined in
Chapter 6, AR 600-85. Use of this information mandates award of a fully
honorable discharge. Accordingly, the Board voted to change the
characterization of service to fully honorable. See response to issue (3)
below.
b. Equity: The parenthetical number(s) below correspond(s) to
the issue number(s) on the DD Form 293, or in Part VI,
Paragraph 1, above.
(3) The issue is accepted. The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses. The Board does not condone the applicant’s
misconduct; however, determined that his narrative reason for separation is
now inequitable. The Board found that the applicant’s misconduct was
mitigated by his addiction to drugs and alcohol and by the length and
quality of his good service. Accordingly, the Board voted to change the
narrative reason for separation to Secretarial Authority. See response to
issue (2) above.
