PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The specific facts and circumstances leading to the applicant’s
discharge are not contained in the available records. The record contains
a properly constituted DD Form 214 (Certificate of Release or Discharge
from Active Duty), which was authenticated by the applicant’s signature.
Her DD Form 214 indicates that she was discharged under the provisions of
Chapter 15, paragraph 15-3b, AR 635-200, by reason of homosexual admission,
with an uncharacterized separation of service. Furthermore, the DD Form
214 shows a Separation Code of JRB (i.e., homosexual admission), and an RE
code of 4.
b. On 21 August 2002, the applicant was discharged. At the time of
discharge, the applicant had completed 1 month, and 4 days of active
military service in the period under review.
c. On 18 June 2002, the applicant enlisted into the Army National
Guard of the United States (ARNGUS). On 18 June 2002, she was ordered to
Initial Active Duty for Training (IADT). On 18 July 2002, she reported for
training at Fort Jackson, South Carolina. On 21 August 2002, she was
released from IADT and discharged from the Reserve of the Army and returned
to the ARNGUS. The applicant was subsequently discharged from the ARNGUS,
effective 21 August 2002. The record contains a properly constituted NGB
Form 22E (Department of the Army and Air Force National Guard Bureau Report
of Separation and Record of Service), indicating that she was discharged
under the provisions of Chapter 8, paragraph 8-26h, NGR 600-200, by reason
of homosexual conduct, with service uncharacterized and an RE code of 4.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 15 of that regulation states that active homosexuality is
incompatible with military service and provides, in pertinent part, for the
separation of members who actively engage in homosexual conduct or who, by
their statements, demonstrate a tendency to engage in homosexual conduct.
The type of discharge will reflect the character of the soldier’s overall
record of service.

a. Propriety: The parenthetical number(s) below correspond(s) to

(1) The issue is rejected. The applicant’s record is void of the
specific facts and circumstances concerning the events that led to her
release from active duty for training and discharge from the Reserve of the
Army. The Board noted that the applicant’s record contains a properly
constituted DD Form 214 (Certificate of Release or Discharge from Active
Duty), which was authenticated by the applicant’s signature. This document
identifies the reason and characterization of the separation/discharge and
the Board presumed Government regularity in the separation/discharge
process. The evidence of record shows the applicant, while in entry-level
status, was release from active duty for training and discharge from the
Reserve of the Army under the provisions of Chapter 15, Paragraph 15-3B, AR
635-200, by reason of homosexual admission with service uncharacterized.
That DD Form 214 also shows that the applicant was properly assigned a
reentry eligibility (RE) code of “4” based on her narrative reason for
separation (i.e., homosexual admission). An RE-4 indicates that the
applicant was discharged with a disqualification (i.e., her homosexual
admission) that cannot be waived and is no longer eligible to reenlist. A
soldier is in entry-level status for the first 180 days of continuous
active military service. Pertinent regulations provide that except in
cases of serious misconduct, a soldier’s service will be uncharacterized
when her separation is initiated while the soldier is in an entry-level
status. A general discharge is not authorized under entry-level status
conditions. A fully honorable discharge may be granted only in cases which
are clearly warranted by unusual circumstances involving outstanding
personal conduct and/or performance of duty. The Board determined that no
such unusual circumstances were present in the applicant’s record and his
service did not warrant an honorable discharge. The Board noted the
applicant’s contentions; however, did not find said contentions
sufficiently mitigating to warrant an upgrade of the discharge under
review. The Board, being convinced that the reason for discharge and the
characterization of service were both proper and equitable, voted to deny
relief.
b. Equity: The applicant has not submitted an issue of equity
and the ADRB has not otherwise relied upon an issue of
equity to change the discharge. The major factors upon
which the discharge was based are set forth in Parts III
and IV of this decisional document.
