PART IV - PREHEARING REVIEW
SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. On 2 March 1992, the applicant was charged with AWOL (910505-
920229). On 4 March 1992, the applicant consulted with legal counsel and
voluntarily requested, in writing, discharge under the provisions of
Chapter l0, AR 635-200 in lieu of trial by court-martial. In this request,
the applicant admitted guilt to the offense, or a lesser included offense.
Further, the applicant stated that he understood that he could receive a
discharge under other than honorable conditions (UOHC) and that the
discharge would have a significant effect on eligibility for veteran’s
benefits. The applicant did not submit a statement on his own behalf and
declined his opportunity to have a medical physical examination. On 5
March 1992 the applicant was placed on excess leave pending final
adjudication of his request for discharge under the provisions of Chapter
10, AR 635-200, in lieu of trial by court-martial. On 1 April 1992, the
separation authority approved the applicant’s request for discharge with a
UOHC.
b. On 15 April 1992, the applicant was discharged. At the time of
discharge, the applicant had completed 2 months and 2 days of active
military service and accrued 300 days of lost time in the period under
review.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 10 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for discharge
for the good of the service in lieu of trial by court-martial. The request
may be submitted at any time after charges have been preferred and must
include the individual's admission of guilt. Army policy states that
although an honorable or general discharge is authorized, a discharge UOHC
is normally considered appropriate.

a. Propriety: The applicant has not submitted an issue of
propriety and the ADRB has not otherwise relied upon an
issue of propriety to change the discharge.

(1) The issue is rejected. The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as the infraction of discipline, the extent thereof, and the
seriousness of the offense. The Board noted the applicant’s contentions;
however, did not find said contentions sufficiently mitigating to overcome
the serious misconduct (i.e., 300 days of AWOL terminated by apprehension)
that led to the his discharge. Further, the Board noted that the applicant
declined to submit a statement on his on behalf and also declined his
opportunity to have a medical physical examination prior to being
discharged. The evidence of record shows the applicant was charged with
the commission of an offense punishable under the Uniform Code of Military
Justice (UCMJ) with a punitive discharge. The Board noted, after
consulting with defense counsel, the applicant voluntarily, and in writing,
requested separation from the Army in lieu of trial by court-martial. In
doing so, the applicant admitted guilt to the stipulated or lesser-included
offenses under the UCMJ. The Board was satisfied that all requirements of
law and regulation were met and the rights of the applicant were fully
protected throughout the separation process. It also noted that the
characterization of service for this type of discharge is normally under
other than honorable conditions and that the applicant was aware of that
prior to requesting discharge. The Board, being convinced that the reason
for discharge and the characterization of service were both proper and
equitable, voted to deny relief.
