                         PART IV - PREHEARING REVIEW

                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 11 January 1994, the applicant
was found guilty by a Special Court-Martial of wrongfully using cocaine on
or about 15 September 1993.  His sentence included:  a Bad Conduct
Discharge; reduction to E1; and confinement for a period of 2 months.  The
record indicates that he was confined from 13 March 1994 to 28 April 1994.
On 29 April 1994, the applicant was placed on excess leave pending the
affirmation and execution of the Bad Conduct Discharge.  On 8 March 1994,
the sentence was approved.  The record of trial was forwarded to The Judge
Advocate General of The Army for review by the Court of Military Review.
On 13 October 1994, the United States Army Court of Military Review
affirmed the findings of guilty and the approved sentence.  On 3 March
1995, the portion of the sentence pertaining to the Bad Conduct Discharge
and reduction to E1, having been affirmed by the Court of Military Review
pursuant to Article 71c, and was ordered executed.

      b.  On 12 April 1995, the applicant was discharged.  At the time of
discharge, the applicant had completed 3 years, 11 months, and 29 days of
active military service (including 349 days of excess leave) and accrued
107 days of lost time in the period under review and had a total of 14
years, 5 months and 23 days of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter 3, Section IV, establishes policy and procedures for separating
members with a dishonorable or bad conduct discharge; and provides that a
soldier will be given a bad conduct discharge pursuant only to an approved
sentence of a general or special court-martial; and that the appellate
review must be completed and the affirmed sentence ordered duly executed.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  The Board found that clemency was warranted
based on the nature of the offense and the overall length and quality of
his service.  Accordingly, the Board voted to grant partial relief in the
form of an upgrade of the applicant’s characterization of service to
general, under honorable conditions.  A change in the reason for discharge
is not authorized under Federal statute.

        (1)  The issue is rejected.  By his misconduct, the applicant
diminished the quality of his service below that meriting a fully honorable
discharge.  See response to issue (2) above.
