                       SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

      a.  Evidence of record shows that on 4 May 2000, DA, HQ, U.S. Army
Armor Center and Fort Knox, Kentucky, Orders 125-0160 discharged the
applicant from the Regular Army, effective 10 May 2000.  The record
contains a properly constituted DD Form 214 (Certificate of Release or
Discharge from Active Duty).  His DD Form 214 indicates that he was
discharged under the provisions of Chapter 10, AR 635-200 by reason of for
the good of the service-in lieu of trial by court-martial, with a
characterization of service of under other than honorable conditions.  The
specific facts and circumstances pertaining to the applicant’s discharge
are not contained in the available records.

      b.  On 10 May 2000, the applicant was discharged.  At the time of
discharge, the applicant had completed 1 year, 8 months, and 23 days of
active military service and accrued 116 days of lost time in the period
under review and had a total of 4 years, 7 months and 15 days of active
military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l0 of that regulation provides, in pertinent part, that a member
who has committed an offense or offenses for which the authorized
punishment includes a punitive discharge may submit a request for a
discharge for the good of the service in lieu of trial by court-martial.
The requests may be submitted at any time after charges have been preferred
and must include the individual’s admission of guilt.  Army policy states
that although an honorable or general discharge is authorized, a discharge
UOHC is normally considered appropriate.

      a.  Propriety:   The applicant has not submitted an issue of
                   propriety and the ADRB has not otherwise relied upon an
                   issue of propriety to change the discharge.

                   Paragraph 1, above.

        (2)  The issue is accepted.  The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
 There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses.  Although the Board does not condone the
applicant’s misconduct, the Board determined that the applicant presented
mitigating circumstances of sufficient merit to partially overcome the
characterization of service granted.  In addition, the Board noted that the
applicant has submitted evidence of favorable post-service conduct, to
include his service in the Ohio Army National Guard.  Given the above
factors, the Board found that the characterization of service granted is
now inequitable.  Accordingly, the Board voted to grant partial relief in
the form of an upgrade of characterization of service to general, under
honorable conditions.

        (1)  The issue is rejected.  The Board determined that the
applicant’s misconduct diminished the quality of his service below that
meriting a fully honorable discharge.  Further, the Board determined that
the reason for discharge was both proper and equitable, and voted not to
change it.
