SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The evidence of record shows that on 23 June 1988, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter l4, AR 635-200, by reason of misconduct – abuse
of illegal drugs (marijuana), with an under other than honorable conditions
discharge. On 29 June 1988 the applicant consulted with legal counsel and
was advised of his rights and the impact of the proposed discharge action.
He voluntarily waived consideration of his case by an administrative
separation board contingent upon receiving no less than a general
discharge. He also submitted a statement in his own behalf. On 11 July
1988, the unit commander subsequently recommended separation from the
service, waiver of further rehabilitative efforts, and characterization of
service of under other than honorable conditions. The intermediate
commander concurred with the unit commander’s recommendation, recommended
disapproval of the applicant’s conditional waiver, and recommended that the
administrative separation board be convened. On 15 September 1988 an
administrative separation board conducted the proceedings in the
applicant’s case. The applicant appeared with counsel. Based on its
findings, the Board recommended separation due to serious misconduct with a
characterization of service of under other than honorable conditions. On
24 October 1988, the separation authority waived further rehabilitative
efforts and directed that the applicant be discharged with a
characterization of service of under other than honorable conditions.
b. On 31 October 1988, the applicant was discharged. At the time of
discharge, the applicant had completed 10 months and 21 days of active
military service in the period under review and had a total of 6 years, 6
months, and 25 days of total military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct. Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave. Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed. Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

(4) The issue is accepted. The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses. The Board noted that the government
introduced into the discharge process the results of biochemical testing
administered solely as a required part of a rehabilitation treatment. In
addition, this same evidence was introduced during the applicant’s
administrative separation board. This is limited use information as
defined in Chapter 6, AR 600-85. Use of this information mandates award of
a fully honorable discharge. Accordingly, the Board voted to change the
characterization of service to fully honorable.

(5) The issue is accepted. Regulations currently in effect list
