SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:
a. The evidence of record shows that on 26 July 2001, the unit
commander notified the applicant of initiation of separation action under
the provisions of Chapter l4, AR 635-200, by reason of misconduct –
commission of a serious offense, with an under other than honorable
conditions discharge. The specific reasons for the action included several
incidents of indecent assault, indecent exposure, using obscene language
toward several military and civilian females, leaving his place of duty,
and being disrespectful toward a senior noncommissioned officer. On 2
August 2001 the applicant consulted with legal counsel. He was advised of
his rights and the impact of the proposed discharge action. He requested
personal appearance before an administrative separation board and did not
submit a statement in his own behalf. On 17 September 2001, he voluntarily
waived consideration of his case by an administrative separation board
contingent upon receiving no less than a general, under honorable
conditions discharge. Again, he did not submit a statement in his own
behalf. On 26 September 2001 his conditional waiver was disapproved. On 1
October 2001 an administrative separation board conducted the proceedings
in the applicant’s case. The applicant appeared with counsel. Based on
its findings, the Board recommended separation with a characterization of
service of under other than honorable conditions. On 23 October 2001, the
separation authority approved the Board’s findings and recommendations,
waived further rehabilitative efforts, and directed that the applicant be
discharged with a characterization of service of under other than honorable
conditions. He also directed the reduction of the applicant to the grade
of Private E-1.
b. On 26 October 2001, the applicant was discharged. At the time of
discharge, the applicant had completed 2 years, 7 months, and 10 days of
active military service in the period under review and had a total of 8
years, 2 months and 23 days of active military service.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200
sets forth the basic authority for the separation of enlisted personnel.
Chapter l4 establishes policy and prescribes procedures for separating
members for misconduct. Specific categories include minor disciplinary
infractions, a pattern of misconduct, commission of a serious offense, to
include abuse of illegal drugs, convictions by civil authorities and
desertion or absence without leave. Action will be taken to separate a
member for misconduct when it is clearly established that rehabilitation is
impractical or unlikely to succeed. Army policy states that an under other
than honorable conditions discharge is normally considered appropriate, but
a general discharge under honorable conditions or an honorable discharge
may be granted.

(1) The issue is rejected. The Board carefully examined the
applicant’s record of service during the period of enlistment under review.
There was a full consideration of all faithful and honorable service as
well as the infractions of discipline, the extent thereof, and the
seriousness of the offenses. The Board noted the applicant’s contentions;
however, did not find said contentions sufficiently mitigating to overcome
the serious misconduct for which the applicant was separated from service.
The Board determined that the applicant's discharge was appropriate because
the quality of his service was not consistent with the Army's standards for
acceptable personal conduct and performance of duty by military personnel.
By his misconduct and poor duty performance, the applicant diminished the
quality of his service below that meriting a fully honorable or general
discharge. The Board, being convinced that the reason for discharge and
the characterization of service were both proper and equitable, voted to
deny relief.
