PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a . Evidence of record shows that the applicant departed his unit at Fort Carson, Colorado on 31 March 1989 in an AWOL status and remained so until he returned to military control on 20 June 1989. On 15 September 1989, Orders 000179-151, DA, HQ, Fort Carson, 4 th Infantry Division (Mechanized), Fort Carson, Colorado, discharged the applicant from the regular Army, effective date: 12 September 1989. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was authenticated by the applicant’s signature. His DD Form 214 indicates that he was discharged under the provisions of Chapter 10, AR 635-200, for the good of the service-in lieu of court-martial with a characterization of service of under other than honorable conditions. Furthermore, the DD Form 214 shows a Separation Code of KFS (i.e., for the good of the service-in lieu of court-martial). The specific facts and circumstances leading to the applicant’s discharge are not contained in the available records.

         b. On 22 September 1989, the applicant was discharged. At the time of discharge, the applicant had completed 9 months, and 21 days of active military service and accrued 79 days of lost time in the period under review and had a total of 12 years, 4 months and 7 days of active military service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 10 of that regulation provides, in pertinent part, that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for discharge for the good of the service in lieu of trial by court-martial. The request may be submitted at any time after charges have been preferred and must include the individual's admission of guilt. Army policy states that although an honorable or general discharge is authorized, a discharge UOHC is normally considered appropriate.

 (4) The issue is accepted. The Board carefully examined the available records for the period of enlistment under review. The Board does not condone the applicant’s misconduct during the period of service under review; however, determined that the characterization of service is inequitable based on the overall length and quality of his total service and his post-service conduct. Notwithstanding the foregoing, the applicant, by his misconduct diminished the quality of his service below that meriting a fully honorable discharge. Accordingly, the Board voted to grant partial relief in the form of an upgrade of characterization of service to general, under honorable conditions. The Board determined that the reason for discharge was both proper and equitable and voted not to change it.
