SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

          a. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty). His DD Form 214 indicates that he was discharged under the provisions of Chapter 9, AR 635-200 by reason of alcohol, rehabilitation failure, with a characterization of service of general, under honorable conditions. The specific facts and circumstances leading to the applicant’s discharge are not contained in the available records . The applicant’s DD Form 214 indicates that the applicant was separated on temporary records.
         b. On 12 February 2003, the applicant was discharged. At the time of discharge, the applicant had completed 1 year, 8 months, and 13 days of active military service in the period under review and had a total of 2 years, 8 months and 17 days of active military service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse. A member who has been referred to ADAPCP for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical.

 (1) The issue is rejected . The Board noted the applicant’s contentions and documents submitted in support of his request for an upgrade of his discharge. However, the applicant’s record is void of the specific facts and circumstances concerning the events that led to a discharge from the Army. The applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was authenticated by the applicant’s signature. This document identifies the reason and characterization of the discharge and the Board presumed Government regularity in the discharge process. That DD Form 214 shows that the applicant was discharged under the provisions of Chapter 9, AR 635-200, by reason of alcohol rehabilitation failure with a characterization of service of general, under honorable conditions. In the absence of independent corroborating evidence to the contrary, the Board was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
