PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

          a. Evidence of record shows that DA, U.S. Army Transition Point, HQ, US Army Fort Dix, Fort Dix, NY, ORDERS 091-001 released the applicant from the active duty and reassigned him to the USAR Control Group, effective 1 April 1993. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant. His DD Form 214 indicates that he was discharged under the provisions of Chapter 5-15, AR 635-200 by reason of failure to meet body fat standards, with a characterization of service of honorable. The specific facts and circumstances pertaining to the applicant’s discharge are not contained in the available records.

         b. On 1 April 1973, the applicant was discharged. At the time of discharge, the applicant had completed 3 years, 8 months, and 26 days of active military service in the period under review.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 5-15, in effect at the time, provided that soldiers who failed to meet the body fat standards set forth in Army Regulation 600-9 would be separated under this provision when it was the sole basis for separation. The regulation provided that the soldier would be given a reasonable opportunity to comply with and meet the body fat standards. The regulation also provided that if no medical condition existed and if the individual failed to make satisfactory progress in the program after a period of six months, then initiation of separation or imposition of a bar to reenlistment was required. The service of soldiers separated under this chapter was characterized as honorable.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (2) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The Board determined that the applicant has successfully served in the USAR for an extended period of time and has met the required weight and physical standards of the Army. The Board also noted that the applicant’s current chain of command recommended a change in his reason for discharge from the Regular Army based on his skills, performance, and dedication to duty. Based on the above, the Board determined that the narrative reason for discharge is now inequitable. Accordingly, the Board voted to grant relief by changing the reason for discharge to Secretarial Authority and changing the applicant’s RE Code to 1.
