PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 21 June 1988, the applicant was found guilty by a Special Court-Martial of Wrongfully using cocaine between (880318-880323). His sentence included: confinement for 3 months; reduction to E1; and a Bad Conduct Discharge (BCD). The appropriate authority approved the sentence; however, suspended confinement for 75 day unless sooner vacated, and except for the part of the sentence extending to a BCD, ordered the sentence executed. On 29 September 1988, the United States Army Court of Military Review affirmed the sentence approved. On 21 November 1988, the applicant was placed on excess leave pending final adjudication of his BCD. On 7 June 1989, the applicant was discharged in with a BCD.

         b. On 7 June 1989, the applicant was discharged. At the time of discharge, the applicant had completed 2 years, 10 months, and 7 days of active military service in the period under review and had a total of 5 years of active military service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 3, Section IV, establishes policy and procedures for separating members with a dishonorable or bad conduct discharge; and provides that a soldier will be given a bad conduct discharge pursuant only to an approved sentence of a general or special court-martial; and that the appellate review must be completed and the affirmed sentence ordered duly executed.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

 (4) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infraction of discipline, the extent thereof, and the seriousness of the offense. The Board does not condone the applicant’s misconduct; however, determined that clemency is warranted. Accordingly, the Board voted to grant partial relief in the form of an upgrade of the applicant’s characterization of service to general, under honorable conditions.

(1-3) The issue is rejected . The Army Discharge Review Board is empowered to change the characterization of the discharge only if clemency is determined to be appropriate. Clemency is an act of mercy, or instance of leniency, to moderate the severity of the punishment imposed. A change in the reason for discharge is not authorized under Federal statute. See response to issue (4) above.
