PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 21 July 1999 the unit commander in consultation with the Clinical Director/ADAPCP declared the applicant a rehabilitation failure. On 26 August 1999, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 9, AR 635-200, by reason of alcohol rehabilitation failure, with a general, under honorable conditions discharge. She was advised of her rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in her own behalf. The unit commander subsequently recommended separation from the service. On 2 September 1999, the separation authority directed that the applicant be discharged with a characterization of service of general, under honorable conditions.

         b. On 17 September 1999, the applicant was discharged. At the time of discharge, the applicant had completed 3 years, 6 months, and 26 days of active military service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse. A member who has been referred to the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical. Army policy states that an honorable or general discharge is authorized depending on the applicant’s overall record of service. (However, an honorable discharge is required if restricted use information is used in the discharge process).

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.
         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

 (3) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. The evidence of record indicates that the applicant, while undergoing alcohol rehabilitation, was appropriately declared an alcohol rehabilitation failure and processed for discharge under the provisions of Chapter 9, AR 635-200. The evidence of record also shows that the applicant was diagnosed by the staff psychiatrist with a “long-standing disorder of character, behavior and adaptability that is of such severity so as to preclude adequate military service.” The staff psychiatrist recommended that the applicant be discharged under the provisions of Chapter 5, AR 635-200, by reason of a personality disorder. The Board also noted the evidence submitted by the applicant referencing her service-connected disability. In view of the foregoing, the Board determined that the characterization of service is inequitable. Accordingly, the Board voted to grant partial relief in the form of an upgrade of the characterization of service to Honorable. However, notwithstanding the applicant’s diagnosed personality disorder, the Board found that command appropriately exercised its option to discharge the applicant under the provisions of Chapter 9, AR 635-200, by reason of alcohol rehabilitation failure and voted not change the narrative reason for separation.

(1-2) The issues are rejected. That portion of the applicant’s request desiring a medical discharge does not fall within the purview of this Board . The applicant has submitted a DD From 149 to the Army Board for Correction of Military Records and her records will be forwarded to that agency for processing. See response to issue (3) above.
