PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 5 December 2002, DA, HQ, III Corps and Fort Hood, Texas, Orders 339-0204 discharged the applicant from the Regular Army, effective 5 December 2002. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty). His DD Form 214 indicates that he was discharged under the provisions of Chapter 14, AR 635-200 by reason of misconduct, with a characterization of service of general, under honorable conditions. The specific facts and circumstances pertaining to the applicant’s discharge are not contained in the available records.

         b. On 5 December 2002, the applicant was discharged. At the time of discharge, the applicant had completed 3 years, 9 months, and 10 days of active military service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

 (1) The issue is rejected. The applicant’s record is void of facts and circumstances concerning events that led to a discharge from the Army. The Board noted that the applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant. This document identifies the reason and characterization of the discharge and the Board presumed government regularity in the discharge process. The applicant was issued orders with an effective date of discharge of 5 December 2002. His DD Form 214 shows that he was discharged on 5 December 2002. The Board found no discrepancy in discharge date in his separation orders and his DD Form 214. The Board, being convinced that the reason for discharge and the characterization of service were proper and equitable, voted to deny relief.
