PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 13 July 2000, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct-pattern of misconduct, with an under other than honorable conditions discharge. The unit commander subsequently recommended separation from the service. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with an under other than honorable conditions discharge. The separation authority directed that the applicant be discharged with a characterization of service of under other than honorable conditions.

         b. On 11 August 2000, the applicant was discharged. At the time of discharge, the applicant had completed 3 years, 3 months, and 10 days of active military service and accrued 5 days of lost time in the period under review and had a total of 5 years, 5 months and 10 days of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

(2) The issue is accepted. The evidence of record shows that the applicant was recommended for discharge with a characterization of service of under other than honorable conditions and that he was not properly advised as to his right to appear before an administrative separation board. Further, the applicant did not waive his right to a board and command did not provide the applicant an opportunity to appear before a board. In view of the foregoing, the Board determined that the discharge is improper. Accordingly, the Board voted to grant full relief and change the reason for discharge to Secretarial Authority and the characterization of service to Honorable. This action does not entail a change to the RE code.
