PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 19 September 2002, mental status evaluation diagnosed the applicant with an adjustment disorder with mixed disturbance of emotions and conduct. On 28 October 2002, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 5-17, AR 635-200, by reason of physical condition, not a disability, with a general, under honorable conditions discharge. He was advised of his rights. The applicant waived legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service and waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a general, under honorable conditions discharge. On 29 October 2002, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a characterization of service of general, under honorable conditions.

         b. On 21 November 2002, the applicant was discharged. At the time of discharge, the applicant had completed 1 year, 2 months, and 14 days of active military service and accrued 8 days of lost time in the period under review.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 5-17 provides that a soldier has a physical or mental condition that potentially interferes with assignment to or performance of duty, the commander will refer that soldier for a medical examination and/or mental status evaluation in accordance with AR 40-501, and excluding conditions appropriate for separation processing under paragraphs 5-11 or 5-13.

2. Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on issues of propriety and/or equity:

         a. Propriety:    The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) and (2) The issues are rejected. The Board determined that the applicant was properly and equitably discharged under the provisions of AR 635-200, Chapter 5, Paragraph 17. The applicant was diagnosed with an adjustment disorder with mixed disturbance of emotions and conduct. The mental health examiner indicated that he did not have a mental disorder; however, that his state of emotional and/or behavioral dysfunction was of such severity that his ability to perform military duties was significantly impaired. He was recommended for separation under the provisions of AR 635-200, Chapter 5-17. Paragraph 5-17 sets forth the procedures for separating individuals who have a physical or mental condition that potentially interferes with assignment to or performance of duty. AR 635-1 (Separation Program Designator (SPD) Codes) provides the specific authorities (regulatory or directive), reasons for separating soldiers from active duty, and the SPD codes to be entered on the DD Form 214. This regulation shows that “Physical Condition, Not a Disability” is the appropriate regulatory citation to be placed in Block 28 of the DD Form 214 for individuals separated under the provisions of AR 635-200, Chapter 5-17.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(3) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review and heard his testimony. There was a full consideration of all faithful and honorable service as well as the infractions of discipline, the extent thereof, and the seriousness of the offenses. Although the Board does not condone the applicant’s misconduct, the Board found that there were mitigating medical circumstances of sufficient merit to overcome the discrediting entries in his service record. Given the above, the Board determined that the characterization of service granted was inequitable. Accordingly, the Board voted to grant partial relief in the form of an upgrade of characterization of service to fully honorable.
