PART IV - PREHEARING REVIEW
SECTION A-ANALYSTS ASSESSMENT
l. Facts and Circumstances:
a. The evidence of record shows that 2 October 1990, DA, HQ, Fifth U.S. Army and Fort Sam Houston, Texas, Orders 196-42 discharged the applicant from the Regular Army effective 5 October 1990. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was authenticated by the applicants signature. His DD Form 214 indicates that he was discharged under the provisions of Chapter 10, AR 635-200 by reason of for the good of the service-in lieu of trial by court-martial, with a characterization of service of under other than honorable conditions. The specific facts and circumstances leading to the applicants discharge are not contained in the available records.
b. On 5 October 1990, the applicant was discharged. At the time of discharge, the applicant had completed 11 months, and 3 days of active military service and accrued 29 days of lost time in the period under review.
2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l0 of that regulation provides, in pertinent part, that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for a discharge for the good of the service in lieu of trial by court-martial. The requests may be submitted at any time after charges have been preferred and must include the individuals admission of guilt. Army policy states that although an honorable or general discharge is authorized, a discharge UOHC is normally considered appropriate.

(2) The issue is accepted. The Board carefully examined the applicants record of service during the period of enlistment under review and heard his testimony. There was a full consideration of all faithful and honorable service as well as the infraction of discipline, the extent thereof, and the seriousness of the offense. While the Board recognizes that the applicant served in the Army a relatively short period of time and does not condone the applicants misconduct, the applicants testimony was credible and he presented compelling mitigating circumstances for the Boards consideration. In view of the foregoing and the many years since the applicants discharge, the Board determined that the characterization of service was inequitable. Accordingly, the Board voted to grant partial relief in the form of an upgrade of characterization of service to general, under honorable conditions.
(1) The issue is rejected. The Board determined that the applicants misconduct diminished the quality of his service below that meriting a fully honorable discharge. The Board also determined that the reason for discharge was proper and equitable and voted not to change it.
