PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

	a.  Evidence of record shows that on 12 February 1995, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct-abuse of illegal drugs, with a under other than honorable conditions discharge.  He was advised of his rights.  The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf.  The unit commander subsequently recommended separation from the service.  The intermediate commanders reviewed the proposed discharge action and recommended approval of the separation action with an under other than honorable conditions discharge.  The separation authority directed that the applicant be discharged with a characterization of service of under other than honorable conditions.  On 10 May 1996, the applicant was notified to appear before a board of officers.  On 12 June 1996, the applicant again consulted legal counsel, and voluntarily waived consideration of his case by an administrative separation board contingent upon him receiving a characterization of service or description of service no less favorable than an honorable, and did not submit a statement in his own behalf.  The unit commander recommended separation from the service with an honorable discharge.  The intermediate commanders reviewed the proposed discharge action and recommended approval of the separation action with an honorable discharge.  The separation approving authority approved the request for conditional waiver, and directed that the applicant be discharged with a characterization of service of an honorable.

	b.  On 11 September 1996, the applicant was discharged.  At the time of discharge, the applicant had completed 2 years, 7 months, and 4 days of active military service in the period under review and had a total of 23 years, 1 month and 16 days of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel.  Chapter l4 establishes policy and prescribes procedures for separating members for misconduct.  Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave.  Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed.  Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

	a.  Propriety:	The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

        (1)  The issue is rejected.  The Board carefully examined the applicant’s record of service during the period of enlistment under review.  There was a full consideration of all faithful and honorable service as well as the infraction of discipline, the extent thereof, and the seriousness of the offense.  Evidence of record shows that the applicant tested positive for marijuana on a unit urinalysis screen and, as a result, was honorably discharged under the provisions of Chapter 14, AR 635-200, by reason of misconduct.  The Board noted the applicant’s contentions; however, the applicant had many legitimate avenues through which to obtain assistance or relief for his problems without committing the misconduct, which led to the separation action under review.  The Board was satisfied that all requirements of law and regulation were met and that the rights of the applicant were fully protected throughout the separation process.  The Board being convinced that the reason for discharge was both proper and equitable, voted to deny relief.
