PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l.  Facts and Circumstances:

	a.  The evidence of record shows that on 2 August 1999, the applicant was charged with fraudulently enlisting in the US Army (980808).  On 26 August 1999, the applicant consulted with legal counsel and voluntarily requested, in writing, discharge under the provisions of Chapter l0, AR 635-200 in lieu of trial by court-martial.  In this request, the applicant admitted guilt to the offense, or a lesser included offense.  Further, the applicant indicated that he understood that he could receive an under other than honorable conditions discharge and that the discharge would have a significant effect on eligibility for veteran’s benefits.  The applicant did not submit a statement in his own behalf.  The unit commander and intermediate commanders recommended approval of an under other than honorable conditions discharge.  On 1 September 1999, the separation authority approved the discharge with an under other than honorable conditions discharge.  The applicant was to be reduced to the lowest enlisted rank. 

	b.  On 10 September 1999, the applicant was discharged.  At the time of discharge, the applicant had completed 11 months and 5 days of active military service.

2.  Legal/Regulatory Basis for Separation Action:  Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel.  Chapter l0 of that regulation provides, in pertinent part, that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for a discharge for the good of the service in lieu of trial by court-martial.  The requests may be submitted at any time after charges have been preferred and must include the individual’s admission of guilt.  Army policy states that although an honorable or general discharge is authorized, a discharge under other than honorable conditions is normally considered appropriate.

2.  Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on issues of propriety and/or equity:

	a.  Propriety:	The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

	b.  Equity:	The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

        (2)  The issue is accepted.  The Board carefully examined the applicant’s record of service during the period of enlistment under review and heard his testimony.  There was a full consideration of all faithful and honorable service as well as the infraction of discipline, the extent thereof, and the seriousness of the offense.  Although the Board does not condone the applicant’s decision to enlist fraudulently into the Army, it determined that he presented evidence of post-service conduct and accomplishments of sufficient merit to overcome the type of discharge granted.  Given the foregoing the Board found that the discharge is now inequitable.  Accordingly, the Board voted to grant partial relief in the form of an upgrade of characterization of service to general, under honorable conditions and to change the narrative reason for discharge to Secretarial Authority.  This action does not entail a change in RE code.   

        (1)  The issue is rejected.  The Board determined that the applicant’s actions diminished the quality of his service below that meriting a fully honorable discharge.  The evidence of record shows the applicant was charged with the commission of an offense (i.e., fraudulent entry for not disclosing a prior felony conviction) punishable under the Uniform Code of Military Justice (UCMJ) with a punitive discharge.  The Board noted, after consulting with defense counsel, the applicant voluntarily, and in writing, requested separation from the Army in lieu of trial by court-martial.  In doing so, the applicant admitted guilt to the stipulated offenses under the UCMJ.  The applicant was appropriately assigned an RE code of 4, which indicates that the applicant was separated from his last period of service with a nonwaivable disqualifier and that he is ineligible for reenlistment.  The Board found no basis upon which to change the applicant’s RE code. See response to issue (2), above.
