PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 4 October 1999, Orders 277-0011, DA, HQ, 7 th Infantry Division and F ort Carson, CO., discharged the applicant from the Regular Army, effective date: 12 October 1999. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant’s signature. His DD Form 214 indicates that he was discharged under the provisions of Chapter l4, AR 635-200, by reason of misconduct with a characterization of service of general, under honorable conditions. Furthermore, the DD Form 214 shows a separation code of JKA (i.e., misconduct-pattern of misconduct). The specific facts and circumstances leading to the applicant’s discharge are not contained in the available records.

         b. On 12 October 1999, the applicant was discharged. At the time of discharge, the applicant had 3 years, 5 months, and 12 days, service on his current enlistment under review.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

          a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

          b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.
(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. All the facts and circumstances pertaining to the applicant’s discharge from service were not in the available records. The available record contain a properly constituted DD Form 214 (Certificate of Release or Discharge From Active Duty) that was authenticated by the applicant’s signature. That document shows that the applicant was discharge under the provisions of Chapter 14, Paragraph 14-12b, AR 635-200, by reason of misconduct (i.e., a pattern of misconduct). The evidence of record also shows that the applicant attained the rank of private first class/E-3 and that prior to his discharge from service was reduced on two occasions and was finally discharged as a private/E-1. In view of the evidence of record and barring evidence to the contrary, the Board presumed administrative regularity in the applicant’s discharge. The Board found no evidence of arbitrary or capricious action on the part of the applicant’s chain of command. Further, the applicant’s contention is not supported by the evidence of record and the applicant has provided no independent corroborating evidence in support of his contention. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
