PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 5 January 1999, prior to the discharge under review, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter l4, AR 635-200, by reason of misconduct—pattern of misconduct, with a general, under honorable conditions discharge. On 22 January 1999, the separation authority directed that an administrative separation board convene to determine appropriate disposition of the recommendation to discharge the applicant from the Army with a general, under honorable conditions discharge. However, the evidence of record shows that eight months later, the applicant was discharged under the provisions of Chapter 10, AR 635-200, in lieu of trial by court-martial with an under other than honorable conditions discharge. The applicant’s record is void of the specific facts and circumstances leading to the applicant’s discharge under the provisions of Chapter 10, however, the record contains a properly constituted DD Form 214 (Certificate of Release or Discharge From Active Duty) that was authenticated with the applicant’s signature. On 15 August 1999, DA Detachment 1, 203d Personnel Service Battalion, Fort Wainwright, AK. Orders 227-0203 discharged the applicant from the Regular Army with an SPD Code “KFS” (i.e., in lieu of trial by court-martial).

         b. On 20 August 1999, the applicant was discharged. At the time of discharge, the applicant had 3 years, 4 months, and 22 days service on his current period of enlistment under review and 7 years, 4 months and 21 days total time in service.

2. Legal/Regulatory Basis for Separation Action: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l0 of that regulation provides, in pertinent part, that a member who has committed an offense or offenses for which the authorized punishment includes a punitive discharge may submit a request for a discharge for the good of the service in lieu of trial by court-martial. The requests may be submitted at any time after charges have been preferred and must include the individual’s admission of guilt. Army policy states that although an honorable or general discharge is authorized, a discharge UOHC is normally considered appropriate.
