PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

 a. The applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant’s signature. His DD Form 214 indicates that he was discharged under the provisions of Chapter 13, AR 635-200 by reason unsatisfactory performance with a characterization of service of general, under honorable conditions. Furthermore, the DD Form 214 shows that the applicant was released from active duty. The specific facts and circumstances leading to the applicant’s discharge are not contained in the available records.

         b. On 21 November 1997, the applicant was released from active duty.
At the time of release, the applicant had 4 years, 2 months, and 12 days, service on his current enlistment under review.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

          a. Propriety:    The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.
(1) The issue is rejected. There was a full consideration of all available records. The available records are void of the specific facts and circumstances leading to the applicant’s discharge from service. However, the applicant’s record does contain a properly constituted DD Form 214 (Certificate of Release of Discharge from Active Duty) which was authenticated with the applicant’s signature. That DD Form 214 indicates that the applicant was discharged under the provisions of Chapter 13, AR 635-200, by reason of unsatisfactory performance with a general, under honorable conditions characterization of service. Baring evidence to the contrary, the Board presumed administrative regularity in the discharge process. The Board found no evidence of arbitrary or capricious command action. Furthermore, the applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that the applicant’s service mitigated his unsatisfactory performance. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.

         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.
